As the preliminary inquiry into the charge of causing death by dangerous driving against former agriculture minister Roger Clarke continued today, a witness in the case told the Spanish Town Resident Magistrate court that the motorcycle driven by the deceased Derron Nicholson had a defective tyre. Certifying Officer from the Island Traffic Authority, Durrant Bennett made the disclosure today. "I was called to Neil's Garage in Old Harbour St Catherine, I saw a Toyota Prado and a Honda Motor Cycle. The motor bike rear tyre was found to have a worn out and chassis damage, " Bennett told the court. He told the court his job as Certifying Officer entails the testing of persons seeking drivers licenses and also vehicles involved in accidents. The two other witnesses called were Derrick Nicholson who identified the body and Oneil Blake, who told the court, that he saw the ill-fated bike about 200 yards away. Blake, said he saw Clarke's vehicle indicate to go right and Nicholson overtook it on the left. He said the next thing he heard was a loud "Bang" and saw the bike crash into the left side of the SUV. The defence only questioned Nicholson by asking him how long his son been driving the bike before the accident. The defence was told three years and that Nicholson was 25-years-old when he was killed. It was revealed that the case would have to continue January 14, next year, as the Accident Reconstruction Report was not ready. Lead Attorney KD Knight QC, said the delay was unfortunate as the defence is ready to proceed. Clarke's appearance arose from an incident about 2:00pm on August 23 along Old Harbour Road. He was heading towards Spanish Town,upon reaching a section of the road he turned right. Clarke's SUV collided with Nicholson who was driving a Honda Bike towards the Old Harbour direction. Nicholson suffered multiple injuries and later died at the Spanish Town Hospital. A file was submitted to the Director of Public Prosecution and a ruling handed down for the Member of Parliament to be charged with causing death by dangerous driving.
