I am sick as a dog, but had to post something.

Believe it or not there was a discussion at school about this (yes, with the kids...dont worry, I teach HS, so the kids are mature for the most part). There seemed to be 2 views with this argument, and it seems to be along the same lines that they are on here (the guys see it one way and the women see it another).

The way I see it. This woman has asked her mate not to do something to her and he has ignored her wishes. Not once, but numerous times. I see it the same way I see asking di current mr. ilp to call when he is going to be late. He does it because those are my wishes and he respects my wishes. Conversely, I respect his.

Lets take sex out of it. Lets say this husband was punching her on the arm and she has asked him to stop, because she only likes to be punched on the leg, but he continues to punch her on the arm anyway, is that OK?

The kids at school seem to think that his continuing to punch her on the arm after she has asked him to stop is not OK. He is dissin' her (to use their words). I also know a little about this issue for this reason. My sister is brought in to one of our local colleges twice a year for freshman orientation, so that people are aware of Maryland law.

In the colleges and universities around here they are lectured about the having sex with incapacitated women. Incapacitated meaning she is NOT lucid (she may be druged, drunk, or a heavy sleeper like in this case) to concent to her mates actions. Under the law in Maryalnd (I will not speak for the rest of the country), having sex with a women while she is unable to concent makes her incapacitated and if she is incapacitated and the man proceeds with sex of any kind, it is concidered here in Maryland a rape. My sister is a PRACTICING distict attorney here in Maryland and this is what she just told me to place here. I guess she is tired of having to adjudicate these cases with these hard headed people. The law works for women as well.

She said that she find this case unusual because it is between a husband and wife. She says that you hear about these types of things at the university levels all the time (and that is true).

To me this situation isnt even about the sex. It is about her husbands lack of respect for her. She said "I dont like that, dont do that", yet he continues...that is disrepectful. I am willing to bet that this man disrepects her wishes in other areas as well. That is the deeper issue to me, the sex just happens to be the mode of his disrespect in this case.
