Welcome again Ms Brown!!

I filed for a certificate of citizenship for a child in July 2007, we have received an acknowledgement stating the application has been received but have not heard further. She acquired her citizenship upon landing (IR3) but would like the CoC as a formality.

USCIS had a price increase at the end of July so I suspect that we are still 'in the queue'. What is the backlog like these days?

u know Kia i could have sworn i posted an ansa to u an it not here, so mek mi try again...have u tried seeing ur file online...if u go to di INS site an put in u file number, it will tell u wat month an yr of ur type of ting it is currently working on....dat way u can approximate wen dem gwine get to u based on ur month an yr of filing...if u wan to get u hands on the paper faster, get in touch wid u senator local office...dem wi sen u a form fi u sign an dem wi expedite matters wid di INS...something as straight foward as dat shud no faze dem [img]/forums/images/%%GRAEMLIN_URL%%/wink.gif[/img]

I think I may have to go to the senator route because all mi have is a receipt seh dem get de money.. so at least I have time /date, etc.. and since dem a come up fi reelection soon maybe dem will be slightly more interested.

BoyKia's took 6 months from start to finish and then I had him go with me so he could do the swearing in as im into the constitution and the political process.

What are the consequences of overstaying on a visitor's visa?

Approximately how long does it take a US citizen to file for a parent?

Can you give a timeline for this process (ie May - submit paperwork; July - receive approval/rejection, etc)

If mi filing for a spouse and they have 3 kids, one turning 18 next month do I have to file seperately for the kids and can the 18 y.o still be included?

Hello again Miss Brown.

I have a complicated set of questions for you.

My very good friend Donna got married in 2005. Her husband is Jamaican also but unlike her he does not have a green card. She filed an I-130 a few months after they got married. Winston, her husband, was previously married to a US citizen and had his work permit but because of the divorce that ended his privilege. He is unable to get one now due to the fact that Donna is a permanent resident and not a citizen.

Now, the complication begins when Winston was actually picked up by ICE in September of 2006 and faced deportation based on the claim that he overstayed after his divorce. And they said that even though he was married to Donna it did not matter, he was to return to Jamaica. They let him go, but on the basis that he would show up for his deportation hearing. He waited and waited but never got any notice of the hearing. He even called the agent who picked him up a few times and the agent told him that it was sent out but still he never received anything.

Thanksgiving of last year he was told by the very same agent who showed up at his home that there was an order of deportation issued for him in New York based on his failure to appear. He used to live in New York with his first wife but now he resides in Connecticut. He asked the agent how comes the order to appear was issued in New York even though they knew he was living in CT. They were the ones who picked him up at his home <span style="font-weight: bold">IN CT</span> in the first place. The agent said that there was nothing they could do and he would have to get a lawyer.

The couple went to an attorney for a consultation and the attorney suggested that Donna get her citizenship, which she has since filed for, but it would cost approximately $4k for him to take the case. They have no money as Donna is the only one who is working, as her husband cannot legally work in the country now.


My questions to you are:

1. How do they go about filing a motion to open, file a stay of deportation, and have the case moved to CT?

2. When Donna gets her citizenship, how do they have the status of the I-130 changed from P.R. filing for Spouse to Citizen filing for spouse?


I don't know if this is of any relevance but Winston has lived in the country for over 10 years.

Next Question:

Girl comes to america as visitor. Marry, has 2 kids here. Her hubby is a an US citizen, he never files for her..visa did expire; yadda yadda yadda (9 years later now) They want to start the filing process but the lady is scared that she will have to leave the states and go back to Jamaica.

IS this true? can they send her home? What do they need to do?

Hello All, and Kia,

Sorry for the delay...it's a busy day...the certificate of citizenship usually takes about one year processing time...it has the lowest priority for processing in local cases. The fee increase and flood of applications does affect the processing times, but US CIS is working diligently to get cases through the system. If the child has a US passport or you have already applied for one, a Certificate of Citizenship is not necessary, but for show it is good to have one. The passport application fee is definitely cheaper and you can get the passport within 6 to 8 weeks as opposed to waiting a year or more.
