The governing Jamaica Labour Party (JLP) will know on Tuesday whether the Court of Appeal will impose an injunction, blocking the holding of the by-election in North East St. Ann.Court of Appeal President Justice Seymour Panton will hand down the ruling.On Friday, attorneys for former People's National Party (PNP) Member of Parliament, Manley Bowen, applied for the injunction hours after Prime Minister and JLP Leader Bruce Golding announced the by-election will take place on December 20.Nomination Day is this Friday.Mr. Bowen and his attorneys are insisting the by-election cannot be held until his appeal is heard in March next year.The attorneys have cited sections 22 of the Election Petitions Act, which bars the holding of the by-election until the entire matter surrounding the seat is settled in court.However, Mr. Golding told a press conference last Friday the constituency has been without representation since September 22.Mr. Bowen, who fought for the removal of Shahine Robinson as MP, is appealing the Supreme Court's decision to declare the seat vacant and not give his attorneys an opportunity to argue for it to be turned over to the PNP's candidate Oswest Senior Smith.In the meantime, despite the threat to stall the by-election in North East St. Ann, the Electoral Office of Jamaica will Monday begin preparations for the polls.Director of Elections, Orrette Fisher, says he is awaiting the Writ of Election from the Governor-General.He told our news centre this is expected to arrive Monday."Once I get the writ, then I will proceed to nomination day, the basic preparations for nomination day like identifying the nomination centre and its availability for Friday and ensuring that the Returning Officer has the relevant document related to nomination,""Once the Writ of Election is issued, then I will proceed with nomination with the election unless there is some court order barring the elections, I am forced to make all the necessary preparations until I am advised through a court order that the election has been called off," Mr. Fisher said.
