Western Hanover Member of Parliament Ian Hayles has been given until January 28 to file his defence in the dual citizenship case brought against him by Jamaica Labour Party (JLP) candidate, Donovan Hamilton. Justice Patrick Brooks, who made the ruling in the Supreme Court this morning, also gave Hayles until February 4 to file an affidavit stipulating the date on which he renounced his United States citizenship. Hamilton went to Court today seeking a default judgement on the grounds that Hayles had not filed his defence in the case. On September 27 last year, the Court of Appeal dismissed Hayles' application to seek leave to take the dual citizenship case against him to the United Kingdom-based Privy Council. The court also ruled that the matter be returned to the Supreme Court for it to be heard. Hamilton filed an election petition last year contending that Hayles was an American citizen when he was nominated to run in the September 2007 general election. Hayles has denied the claim. He said he had renounced his American citizenship long before Nomination Day.
