Presiding judge Jim Moodie has shot down a request for confessed drug dealer James Mack to be brought to court to testify in the Buju Banton case. David Oscar Markus, Buju's attorney, this morning told Moodie he intends to call Mack as his next witness. He said Mack, who the court has twice ruled cannot be compelled to come to court, had not properly invoked his 5th amendment right when he opted not to testify. In making the ruling, Moodie said "I will not let you call him and I will not let you put into evidence the hearsay of his affidavit." Mack pleaded guilty to cocaine related trafficking after he was held in a Florida warehouse trying to purchase the drugs from undercover detectives. He was Buju's co-defendant but Buju said the first time he met him was in jail in December, 2009. Mack has said in his affidavit that he has never met Buju before. Buju is currently on the witness stand being cross-examined by US prosecutor Jim Preston.
