The Appeal Court has ruled that Daryl Vaz, Jamaica Labour Party (JLP) Member of Parliament (MP) for West Portland can appeal the Chief Justice's ruling to disqualify him as MP.
The court ruled against an application from Abe Dabdoub, the People's National Party candidate to block Mr. Vaz's appeal.
Mr. Dabdoub had asked the court to strike out the appeal claiming it was an abuse of the process of the court.
However, the panel of judges disagreed and ruled in favour of Mr. Vaz.
The Appeal Court is to hand down its written reason for its decision next week.
The action now paves the way for the JLP MP to challenge the decision of the Chief Justice to disqualify him because he is a US citizen.
In April Chief Justice Zaila McCalla ruled that Mr. Vaz should be removed and that a by-election be held to select a new MP for West Portland.
This prompted Mr. Dabdoub to file an appeal claiming the seat should have been turned over to him once Mr. Vaz was disqualified.
Mr. Dabdoub's appeal is scheduled to be heard on November 24.
