Doc not guilty - Gynaecologist freed of rape charges

DR. MATT Myrie, who was accused of raping a patient at the Victoria Jubilee Hospital in February last year, wept openly in court yesterday when a seven-member jury freed him.

The 32-year-old gynaecologist had been on trial in the Home Circuit Court since May 8.

After Mrs. Justice Marva McIntosh told him he was free to go, Dr. Myrie and his wife, who was also in tears, hugged each other and left the courtroom. His wife attended the trial daily.

The allegations were that, on February 26 last year, the complainant was taken to the ultra sound room at the hospital where Dr. Myrie was attached. Evidence was given that the complainant was raped in the ultra sound room.

UNSWORN STATEMENT

Dr. Myrie was charged with rape and indecent assault but the jury, after retiring for more than an hour, found him not guilty of both charges.

The Crown, represented by Dirk Harrison, Crown Counsel, called 16 witnesses at the trial.

Defence lawyers, Bert Samuels, Jacqueline Samuels Brown and Keisha McDonald, thoroughly cross-examined the complainant.

In an unsworn statement from the dock, Dr. Myrie said he was innocent of the charges. Dr. Myrie was on bail in the sum of $500,000 with surety.

Lilly Claire Belay, legal officer at the Ministry of Health, watched the proceedings on behalf of the Ministry

How many choices of employment does nurses have in Jamaica?
Who are the supervisors of nurses in the field?
Some one simply point out to her that she will need to work for aliving and since in Jamaica unlike the US they allow physicians to supervise nurses,and there is one main employer,in which the Docs peers will be her boss,what option does she have?
There is so much changes need for Jamaica to be a civilized place where all are treated with some respect.
Not to say that the civilization quotient is so well represented in the 'civilized' places of this world though, but Jamaica is a special case..

Under the Jamaican consitution there is the right not to swear in court..... I also beleive that there is no requirement to afirm.. However purjury is still a crime..

I read the Jamaican consitution along time ago and beleive it is a remarable document however it is not enforced for the majority of Jamaicans...

the constitution serves the politician more than it does the people. if there is no 'right' that is explicitly stated, an ordinary Jamaican is not entitled to it.

I cant remember the fella's name now, but he heads some justice body in governemt(he has a head full of white hair against dark skin- does anyone remember him- was once a PNP minister) he once said something against giving the people Justiciable rights.
There are no balance checks so the politicians are the ones who appoint judges and so on. isnt that a conflict of interest?

now as to how i understand it that was said when the constitution was being crafted....however since then there have been amenmendments to the constitution including a charter of rights( a so dem call it?).

if this was said at the very drafting of the rule of law then is it any wonder that Jamaica is in the state that it's in today given the contempt the drafters showed? that statement is contemptuous at best.

The charter of rights means squat when it comes to real rights of the people, you could drive a truck through some of the legal loopholes, coupled with the fact that the CCJ, a creation of the PNP and a few other regional govt(against opposition protest btw), now has what amounts to final say on what goes such that if the people (eg portmore against the govt re turning the causway into a toll road) have a dispute with the government one can easily predict who is coming out the victor.
