when one chose to break it,the result could be devastating to just about every individual or entity that does business with that institution.
can you imagine if this was to happen in a place like CAYMAN??

THE Jamaica Bankers Association (JBA) yesterday moved to rebuild confidence in the banking sector, warning employees that they would face disciplinary action for breaching customers' confidentiality rights.

The bankers also promised further measures to establish procedures that would foster compliance with provisions of the Banking Act, in a statement that made no mention of, but was obviously related to, the Trafigura affair triggered by information leaked from FirstCaribbean International Bank (FCIB).

"The JBA wishes to assure the members of the public that the confidentiality of customer information is one of the core principles by which we operate and is an obligation which we will continue to uphold," the association said.

The Bankers Association, which is headed by ScotiaBank's Bill Clarke, along with the Jamaica Council of Churches (JCC) and the Jamaica Manufacturers' Association (JMA), yesterday joined other organisations raising concerns about the ruling People's National Party's (PNP's) acceptance of $31 million from Trafigura Beheer, the international oil trading company that lifts and sells Nigerian crude on the international market for Jamaica.

Information about Trafigura's hefty deposit into an account named CCOC, used by the PNP for campaign purposes, was leaked from FCIB to Opposition Leader Bruce Golding.

Severely embarrassed by the furore that followed the disclosure, PNP general-secretary and information and development minister Colin Campbell stepped down Monday, and Prime Minister Portia Simpson Miller ordered the money sent back to Trafigura.

Yesterday, the JBA emphasised that "the Banking Act imposes on every bank employee a duty of confidentiality in relation to any information regarding the money or other relevant particulars of the accounts of customers". It pointed to the limited exceptions as outlined in the Banking Act where such disclosures can be made.

Disclosures are allowed when customers give written consents; when it is ordered by the court; through a directive given by the Ministry of Finance and Planning, as well as a requirement through other Acts such as the Money Laundering or Terrorism Prevention Acts. In this case, the disclosure is made to the designated authority.

The JBA insisted that its employees must observe and comply with the provisions of the Banking Act dealing with the confidentiality of customer information at all times.

In the wake of the leak, FirstCaribbean sent a senior executive, Sonia Christie, on leave while it investigated the incident that was used by Golding to embarrass the Government.

Yesterday, Observer sources said FCIB has been pursuing other angles besides Christie, as it dug frantically to plug the leak, apparently the first in its 86 years of operations in Jamaica.

The source said the bank was on the verge of apologising to Christie, who was not directly accused, but who has been embarrassed by the publicity surrounding her being sent on leave.

Christie is the wife of Falmouth deputy mayor Fitz Christie and a relative of the Jamaica Labour Party's Pearnel Charles.

For its part, the Jamaica Council of Churches (JCC) yesterday called for the establishment of policy guidelines for campaign financing and offered assistance in developing such guidelines.

In its statement, the JCC called on all recognised political parties in Jamaica to lead a campaign marked by integrity by publicly declaring all local and foreign funding, as well as material gifts received and utilised since this January.

"The council is deeply disturbed by the circumstances surrounding the $31 million from Trafigura Beheer to the People's National Party," the statement read.

Taking note of Campbell's resignation and Attorney-General A J Nicholson's apology for statements made last week, the JCC said it hoped those were genuine efforts towards achieving accountability.

It expressed support for the prime minister's decision to have the funds returned "if it is indeed a gift", as initially claimed by
the party.

The JCC said it was also "appalled at the breach of confidentiality in the client/banker relationship" and called upon FirstCaribbean to state publicly the nature of the sanction meted out to the staff responsible for the breach.

"We wish to further register our disapproval of how confidential information was received and exploited," the statement noted

PNP unable to return Trafigura millions right away

The beleaguered People's National Party (PNP) has encountered a setback with its plan to return $31 million to the Dutch oil trading firm Trafigura Beheer.

It has been revealed that the party will not be able to send the money directly to Trafigura as it has no formal arrangement with the company.

As a result, the Party will have to use a different channel to return the funds.

According to reports reaching the RJR News Centre, the PNP will be required to re-lodge the money to the bank account operated by the controversial CCOC which received the disbursement more than a month ago.

CCOC will then be responsible for sending the money back to Trafigura.

However, this could pose another dilemma for the party as arrangements were being made to close the account in the wake of confidential bank records on the Trafigura transaction being made public by the Jamaica Labour Party.

When contacted, former PNP General Secretary, Colin Campbell, who has been linked to CCOC, declined to state whether the account was still open.

Wednesday night a PNP insider indicated that in light of the development, it could take a while before the money is returned to the Netherlands.

On Sunday PNP President Portia Simpson-Miller instructed that the money be given back to Trafigura in the wake of the controversy surrounding the alleged donation.

It was first reported that the money was sent to CCOC as a gift to cover the PNP's campaign expenses.

However, the controversy over the donation took a shocking turn last Friday when Trafigura issued a statement denying that the money was a gift.

It said the disbursement was part of a commercial transaction.

Last week Mr. Campbell explained that CCOC was formed in support of his constituency work.

When he moved away from representational politics it remained open, evolving into a fundraising account with a wider remit to support the work of the PNP Secretariat.

But even CLOSER – a microscope should be help to the information that was exposed.

That is what My Friend P and I think about this People's National Party campaign funding Trafigura fiasco that is currently dominating some of the newspapers. As I have noted, my People Paper has as per usual recognised that there are far more important issues to talk about.

Anyway, please don't get us wrong. It is not that we do not believe there is merit in trying to ascertain whether or not the ruling party, the PNP, did something untoward when they were seeking funding for their political campaigning. Nor are we chastising the opposition Jamaica Labour Party for engaging in their 17-year-pastime of screaming 'look what they did now'.

Our question is when you look at the bigger picture, THE LOOMING GENERAL ELECTION, does this story and its details really mean anything? Will this Trafigura scandal, including the resignation of the former supporting star of the last Cable and Wireless advertising campaign [and, no we are not referring to Pressa] really determine in any serious way the final outcome at the polls?

P and I think not. Sad, but true. You see this Trafigura fiasco is being blasted on the front pages of the morning papers for one week straight, on all the radio and television newscasts and, of course, provides excellent fodder for the vomit talkshows in the morning and afternoon. Most certainly middle class Jamaica and above have their eyes peeled and ears on cock for all of this juicy scandal. But alas, if even all of middle class Jamaica and the paltry few above were to vote [which they won't] it really would not make a difference to the outcome of the election now would it?

The mass will decide the future of the country whenever the election is held and neither P or I think that the mass gives a rat's behind about any of the current debate. First up pronouncing that foolish name Tra-fi-gu-ra presents enough of a problem for most of us. Then, trying to wrap your mind around a simple issue of right and wrong, leaves many people in wonderment about the basic premise of this debate. You have a friend that has given you money because he likes you, and this is wrong!? Are we to expect the opposite? Okay then in the future the expectation is that all PNP funding will come from JLP supporters and all JLP funding will come from PNP supporters. Huh?!

That's right, call me an idiot, but that it is where the discussion has been going. Show categorically that the funding money provided is state funds and I have a major problem, because straight up, that is theft. Anything else is really going to stretch it. But that is what I think, do you think mass Jamaica really, really cares? A storm in a teaspoon I say

The female employee of First Caribbean International Bank, who was reportedly sent on leave in the midst of the Trafigura affair, is back on the job.

Checks with the bank Thursday confirmed that the employee is back at work, but our attempts to speak with her were unsuccessful as her colleagues said she was not at her desk.

A well-placed source revealed that the employee was on leave for only three days.

It was reported last week, that the bank was carrying out intensive investigations to identify the person or persons who leaked details of the PNP's account to the JLP.

But even as First Caribbean was at the centre of controversy last week, some of the focus was shifted to First Global Bank where the authorities are reportedly carrying out investigations.

The cheque was reportedly written on First Caribbean Bank's account and lodged to First Global.

First Caribbean bank had said in a release shortly after the employee was sent on leave, that it had made significant progress in its investigations.

While not giving details, the Bank said it has taken the appropriate preliminary action.

It stated that it had also notified the legal authorities and regulatory bodies of the progress it has made.

First Caribbean promised that it would leave no stone unturned as it continues its investigation.

The bank has already admitted that the leak of the confidential customer information is a matter which it is treating seriously.

Documents showing income tax liabilities of Opposition Leader Bruce Golding, stamped by the Inland Revenue Department in Old Harbour, St. Catherine, were leaked to The Gleaner yesterday.

Verified as genuine by Mr. Golding's accountant, Victor Hamilton, the documents, signed by him, acknowledge the indebtedness of Mr. Golding of $1,007,856 as of May 3, 2004, for the years 1998-2002. The accountant said the money had been fully settled. Mr. Hamilton said the liabilities related to taxes owed by Mr. Golding's bakery in Old Harbour.

He said the final payment of $346,070 on January 18, 2005, overpaid by $48,000, Mr. Golding's debt. He produced receipts for three instalments but given the short notice of the reporters' visit, he was unable to produce documentation to support the final payment.

"Well, I don't need to question what possible source this is coming from ... Evidently they are prepared to go and delve into persons' tax liabilities. That is very interesting!" said Mr. Golding speaking on Mr. Hamilton's office telephone. The Jamaica Labour Party leader himself revealed in Gordon House last week bank documents showing the $31 million 'gift' from Dutch oil company Trafigura Beheer to the People's National Party (PNP). That revelation has embarrassed the Government and set off a firestorm. One minister has resigned in the wake of the scandal and Prime Minister Portia Simpson Miller is yet to comment on the matter.

Mr. Golding declined to speculate upon the source of the leak but said that he would carry out investigations.

Alarmed

"I'm astonished," said his accountant, noting that having practised for the last 30 years, such a leak was in his view, unprecedented. "This is a very serious matter; this is a personal matter between the individual and the commissioner of the Inland Revenue Department."

Interviewed shortly after at his downtown King Street office, Inland Revenue Deputy Commissioner Padan E. Manning expressed concern that the leak might have come from his department but said it was too early for the documents to be verified or for further comment.

The bank documents produced by Mr. Golding at Gordon House last week Tuesday were cheques drawn on FirstCaribbean International Bank showing transactions with CCOC Associates, linked to Mr. Campbell and the PNP.

In a statement yesterday, FirstCaribbean denied that it had fired an employee and that the leak had come from the bank. "FirstCaribbean has not, at this point, accepted any responsibility for any alleged breach of customer confidentiality," the statement said.

What is the true intention of her remaining silent on this matter?
Is she so embarassed?

Omar Davies and the Derrick Lattibeaudare dont know about 31 mill being lodged in Jamaican account or accounts even if lodged in broken down 00,000`s?
The banks require by law that when certain amounts are being lodged that information be given by the source as to where the money came by and for what purpose.

Not a word from Solid as a sox comrade Peter Phillips, nor from any other senior PNP stalwart except from mushings from the grass root like J-can and others lost of the ability to bare shame.
Judas was indeed an honourable man on realizing what he had done, he resigned not from the apostleship but also from life itself.
