Campbell’s secret deal

The secret agreement between CCOC Association, an entity linked to former minister of information and development, Colin Campbell, and international oil trading company Trafigura Beheer, calls for the delivery of a feasibility study on Jamaica’s bauxite and alumina industry within six months, investigation by the Sunday Herald has revealed.

The agreement, described as a “dummy contract” by political insiders, came in force some time in September with CCOC as consultants. It was agreed that CCOC would provide an in-depth study to facilitate the pre-financing, purchasing and marketing of bauxite and aluminia, which would be delivered within six months.

The Sunday Herald was not able to ascertain payment terms, but sources said that the money was paid in tranches to the CCOC.

According to sources, minister of industry, technology, energy and commerce, Phillip Pauwell, introduced the Trafigura officials to Campbell and told him of their intentions, and both parties held subsequent meetings.

The Sunday Herald was not able to find out all the clauses in the document, which sources said comprised 11 pages and was a well-written legal document covering Trafigura.

Up to yesterday, Prime Minister Portia Simpson Miller had not seen the original copy of the document, which Trafigura promised to make available, but insisted that it would not be electronically transmitted after the latest development. This, PNP sources, say might result in the Prime Minister sending an emissary to collect it from Trafigura.

It is also understood that the Prime Minister’s decision to return the $31 million has run into some problems, as Trafigura is refusing to accept the money on the grounds that it did not give any funds to the government. Indications are that the money will have to be returned via CCOC to Trafigura. This latest development, insiders say, is posing a challenge to the administration.

Trafigura’s broad reach

Information on Trafigura’s website indicates that the company’s metals and minerals activities are conducted through its offices in Lucerne, Stamford, Lima, London and through its network of branch offices and agencies.

The division trades in all forms of the non-ferrous metals of copper, lead and zinc, including ores, concentrates, refined metals, scrap as well as by-products including associated precious metals. The division also trades alumina.

The non-ferrous division is involved in all stages of metals trading from mining to the final consumer, and provides a full range of client support services covering marketing, risk analysis, financing and commodity related derivative products.

Trafigura continues to expand the geographical reach of its trading activities and has a major presence in the mature markets of the developed economies in Europe, the United States and Japan and in the developing markets of South and Central America, South East and North Asia, Eastern Europe and the Commonwealth of Independent States (CIS) consisting of 11 former Soviet Republics.

Nothing to hide

In the wake of the Trafigura affair, Prime Simpson Miller told the Sunday Herald that she has instructed Cabinet Ministers presiding over ministries doing business with the private sector to examine all contracts in order to ensure that everything is above board.

The Prime Minister said that she has given instructions to close the controversial party account “SW Services”, as soon as the $31 million has been returned to Trafigura. SW Services was used in one of the transactions leaked to the Opposition JLP last week.

The Prime Minister also sought to clear two accounts established in her constituency pointing out that no money from Trafigura was deposited in any of them. One of the account in the name of “SW Services SE” and the other, “SW Inc” were established to raise funds for her constituency and are not used by the party. The Prime Minister said that she was willing to open up her bank account to the public as she had nothing to hide.

Turning to other matters, the Prime Minister also issued a new charge for ministers to pay specific attention to issues affecting the poor. She said that this was necessary to protect the interest of those at the bottom of the economic ladder who are most vulnerable to abuses.

The Prime Minister maintained that she was now getting all the facts before she reported to the Jamaican people.

In a week when Trafigura continued to dominate the news, the Jamaica Labour Party (JLP) was leading the governing People's National Party (PNP) in the public relations stakes and could transform it into electoral advantage unless the prime minister moves quickly and decisively to resolve the crisis.

Quite simply, this means that Prime Minister Portia Simpson Miller will have to do whatever it takes to show her considerable body of supporters and the entire country that she is serious about cleaning house, even if that means removing senior people who have been near and dear to her.

The prime minister, it seems to me, has to make a nationally televised broadcast to convince the nation that she takes the matter seriously and that she is in control of the process to bring closure to the crisis that has gripped her party and government since the JLP leader let loose what he called "the mother of all scandals".

Given the fallout to date and the unanswered questions that surfaced during the week, it may be a difficult but not impossible task if the prime minister invests her substantial political capital to dealing with the issue.

Up to Thursday (at the time of writing), Jamaica House was saying that the prime minister would be addressing the nation but the date and form of the address had not yet been determined.
Opposition Leader Bruce Golding dropped the political bombshell on October 3 when he revealed - complete with returned cheques and bank statements - that the PNP had received $31-million from the Dutch oil trading firm, Trafigura Beheer, which financed the party's huge annual conference in September.

The allegation was that the money looked and smelled of 'kickback', but the allegation was vociferously denied by PNP chairman Robert Pickersgill, Attorney-General and PNP legal adviser AJ Nicholson and other officers who asserted that it was an unsolicited gift as a campaign contribution that was neither illegal nor unethical.

But the confidence evaporated as quickly as it emerged when Milton Walker of CVM-TV and Hot-102 broke the story that Trafigura was denying that it was a campaign gift, saying that it was, in fact, a commercial transaction with CCOC Association.
I believe it was Harold Wilson, a British prime minister in the 1960s, who famously remarked that a week in politics is a long time.

The past seven days must seem like an eternity for the Government and the PNP as they remained on the defensive, pinned to the crease to use a cricket metaphor, unable to make anything looking like a scoring stroke. As indications of the defensive posture:
. Colin Campbell resigned as minister of development and information and general-secretary of the PNP;
. The prime minister ordered that the money be returned to Trafigura;
. The attorney-general apologised to the nation apparently for talking without full knowledge of the facts or that there was 'hanky-panky'; and
. The prime minister confirmed that she had received a courtesy call from two officers of Trafigura who were in Jamaica in August.
Resignation and apologies notwithstanding, the story has gone past the nine-day wonder and refuses to go away, partly because new angles keep coming almost every day.

Only Thursday, it was being reported that there is no contract between Jamaica and Trafigura for them to trade Nigerian oil on our behalf, although the company's name is on the 2006-07 contract signed September 20 between Jamaica and Nigeria to renew the facility.

The silence of the senior PNP leadership over the past week may be in the hope that the story will play itself out and disappear. Maybe. But it also leaves the impression that the party is in a state of crisis and uncertainty about how to resolve it.

Meanwhile, there is no doubt that there has been a great loss of credibility over both the substance and handling of the issue.
The credibility problem begins with the fact that the party and Government have been reacting - rather than leading the effort to get to the truth of the issue - and because some explanations just don't make sense. A few examples:

The explanation that CCOC Association stands for 'Colin Campbell Our Candidate 'came from a story in the Observer, despite several opportunities presented to PNP officers to explain what Pickersgill and other officers insisted on calling a 17-year-old PNP account.
Next, there is the credibility problem surrounding the reasons for Mr Campbell's resignation.

In his letter, he explained that he had "not shared the full details" of the funds from Trafigura with the president, chairman, the legal adviser and other officers of the Party and hence he takes "full responsibility".

The explanation that $30 million was deposited into the Party's campaign funding account in three lodgements starting September 7 and remained unknown to any other officer of the Party up to October 7 may very well be true. But as my colleague Mark Wignall commented in the Observer last Thursday, it is an explanation that is "extremely hard to swallow".

Another huge credibility problem has to do with who met with Claude Dauphin, president of Trafigura, and another officer of the company in Jamaica on August 23 and what was discussed at these meetings.
After Bruce Golding raised this question at a press briefing Tuesday, Press Association of Jamaica president and Sunday Herald editor Desmond Richards reported on several radio shows that the prime minister had told him in an "exclusive interview" that the two Trafigura officers paid a courtesy call on her at Jamaica House but there were no Cabinet officers present.

The mystery surrounding the meetings has left the JLP asking: What did the prime minister know and when did she know it?
The second problem facing the party and Government is that the crisis has reopened wounds inflicted among senior PNP members during the leadership race earlier this year.

From all appearances, Mrs Simpson Miller was reaching out and doing a great deal of healing at the annual conference last month and there were signs of unity as all factions recognised that, despite the leader's personal popularity, any chance of a fifth term depended on a united party, not just her 'dress tail'.

Now, the word is that some members of the party's executive, who huddled for the most of last weekend, are concerned that their political future may be in the hands of a few people who are not accountable to the founding principles and organisational structures of the PNP.

Furthermore, Mr Campbell's resignation as general-secretary has not only left a huge gap in the inner circle of the PNP president, but has opened up a debate about succession.
The front-runners were said to be Paul Robertson, a former backer of the Peter Phillips 'Solid as a Rock' leadership effort; Donald Buchanan of Omar Davies' 'Prosperity' campaign and Easton Douglas,who was a key member of Team Portia.

Dr Robertson, a former general-secretary and now the campaign director, is regarded as experienced and a safe pair of hands, but the expectation was that the leader would choose someone from her winning team, even if that meant he would have to spend some time learning the ins and outs of the Party machinery. Whoever is chosen must be in place soon and on the campaign trail.

Then there is also the uncertainty over the actual status of the refund of the contribution. RJR was reporting Thursday that the PNP had run into a snag in refunding the money because it has to come from CCOCA as Trafigura had no dealings with the People's National Party. It's unclear whether CCOCA still exists.

But the biggest nightmare for the prime minister must be how to answer the questions that an invoice and a contract were generated in order to give legal effect to the transfer of funds from Trafigura.
Where are these documents? What do they say? Was there anything about providing services in return for the money?

The intent may very well be that the documents were to provide a cover for Trafigura which is under strict European and Dutch laws against payments to foreign officials that could look like bribery.
The Organisation for Economic Cooperation and Development (OECD) in the late 1990s ratified a "Convention on Combating Bribery of Foreign Public Officials in International Business Transactions" which can punish corporations and their officers for corrupt practices abroad.

The convention requires contracting parties to "take such measures as may be necessary to establish that it is a criminal offence" for a company to engage in "bribery of a foreign public official" in order to "obtain or retain business".

The Dutch Government acceded to the convention in 2001 and amended the country's Penal Code to extend the application of the active domestic bribery offences to the bribing of foreign officials. Violations are punishable by hefty fines and imprisonment.

Given Trafigura's run-ins with international law as an oil trader, its current imbroglio in Cote d'Ivoire where Dauphin is now in jail for the company's links to alleged dumping of toxic waste causing the deaths of least eight Ivoireans and injury to hundreds, it is understandable that it would want to cover its flanks in Jamaica.

Unless I see hard evidence to the contrary, I hold firmly to the view that the prime minister had no prior knowledge of the transaction and her hands are clean.

That is a very good place from which to come to the nation and tell us how she is going to lead her party and the Government out of a crisis that has implications way beyond the political careers of those who have been closest to it.

PNP silent on latest scandalous Trafigura allegations

Senior People’s National Party (PNP) officials are refusing to respond to allegations by the Sunday Herald newspaper that CCOC Association had inked a deal with the international oil trading firm Trafigua to conduct a study of Jamaica's bauxite and alumina industry.

The newspaper described the agreement as a "dummy contract" which provided for the company to pay millions of dollars to CCOC without breaching international laws.

However so far our efforts to get a response from senior PNP officials have been thwarted by unanswered telephones or silence.

PNP officials who would speak declined to comment on the latest claims, arguing that the party would be addressing the matter shortly

New Information Minister Donald Buchanan, who is tipped to be appointed PNP General Secretary this week, told our News Centre that he was not ready to discuss the allegations.

Mr. Buchanan said the issues concerning Trafigura prove it is important that the country moves quickly to settle the question of the disclosure of contributions to political parties and public financing of election campaigns.

and all thes posters who have been bashing PJ Patterson for a statement 'et al' Of laws not to be a shackel. Prove with their reaction to this incident, that they believe that 'the law should not be a shackel' as long as the result of breaking it is justified. Pity they don't know how popular that belief is with criminals. They all justify breaking the law,as long as it justified their ends.

We certainly don't, but it is a pity again that people of such noble actions can err in their judgement,due to emotional instead of logical reaction.

I too am worried by the release of bank info. That is a very serious..

But the source of finance for the party confrence. Merely confims an aura of poltical corruption... ??? And why do they need a broker for oil ?????? There is something about Trafigura that I just cant remeber.....

I thought that you cannot sue a MP for making a statement in the house..I thought it was covered by parlimentary privilege.. The only recourse is if the statement is an outright lie, the MP can be censored by the speaker... The idea is if you could sue an MP for a statement in the House, then to stop a debate you could sue him and until the matter is completed in court the matter cpould not be discussed in the house... impractical...

Well I think it was attempt at laundering money @ the highest level and I am glad I saw through it and reported it at the time. The dead give away was the argument about the phone lines for poor people to call in and donate funds.

She couldn't be a give specific then and none has been forth coming since.

Portia established her self as a great leader yesterday in Parliament during the debate started by Opposition leader Bruce Golding expressing a no confidence vote on the Govt. by applying typical Damage Control 101 steps.

The following is part of an excerpt taken from todays Jamaica Observer:-

During yesterday's debate, Prime Minister Portia Simpson Miller broke her two-week long silence on the issue with a brief response to Golding's charges.

She emphatically denied any wrongdoing in the transfer of the funds to her party's account, although she reminded the House that she has asked that the money be returned. She also reiterated the party's claim that the Trafigura controversy was an attempt to divert attention from the censure motion against JLP general-secretary Karl Samuda.

Simpson Miller called on the Opposition to join hands with the Government and participate in the Joint Select Committee of Parliament it has proposed to discuss a bill on party funding and registration tabled by Independent MP Abe Dabdoub.

But Golding was not amused. He said that after two weeks of waiting for a response from the prime minister, her contribution was very disappointing.

He said that it was either that the prime minister did not appreciate the fundamental issues involved in the controversy, or she was not prepared to confront them.
He said that the Government missed a golden opportunity to lay the full details of the arrangements with Trafigura on the table of the House for public information.

Earlier in the debate, minister of housing, transport, water and works, Robert Pickersgill, admitted that he had blundered in telling the public earlier that the contracts between Jamaica and the Nigeria National Petroleum Corporation (NNPC) and Trafigura had been signed.

A Ministry Paper tabled last night in the House by minister of energy, commerce, industry and technology, Phillip Paulwell, who did not take part in the debate, stated that while the Petroleum Corporation of Jamaica (PCJ) had signed the renewal documents to the evergreen contract with the NNPC, it was not yet finalised by the NNPC, and that the contract with Trafigura, which expired in December 2005, has not yet been renewed.

However, he said that Trafigura will continue to service the contract until the PCJ completes the tendering process and decides on a lifter for 2006/2007.
