My fellow Jamaicans. While you're hanging from buses and car windows, or lying on top of moving vehicles, shouting and supporting the party of your choice (JLP or PNP), While you're KILLING YOUR OWN BROTHERS over politics. Have you stop to consider the following.
1) The Queen of England is your head of state.
2)Your highest court is the Privy council.
3)They are both located in a country(England) which you cannot enter freely.

Massa, anyweh we go we`re trapped, what else is new?

We`re trapped by the confines of the beautiful Caribbean Sea, nowhere to run, except to fly or sail.

Witht he sad state of Justice in Jamaica we are lucky to have the Privy Council located wherever if in the UK.

The Judges in the Privy Council are not made up solely of UK Justices. They come from the wider Commonwealth nations. They only sit in the UK.
What better way to have neutral ground for your final and ultimate court of appeal.
With the spate of corruption in Jamaica where even the justice system seems tainted, where many cases take 5 and more years to be heard, where the magistrate takes notes by hand-writing, count yu blessings and think again and dont be fooled into the trap that we are being held back by former colonialists.
We are holding back ourselves by our ineptitude and inertia.

Of all the things I find wrong with the politics of Jamaica, is the fact that one hahe to be granted a right of entry by a foreign power to access your highest court which is in this foreig country.
The day a visa was instituted,should be the day the privi counsil sstop being the highest court of justice.
Any person who cannot trust any group of Jamaicans to issue justice on Jamaicans says a lot about their belief in the abillity of Jamaicans to be honest.
I think it is false to think that we can't find a few hionest Jamaicans capable of applying the laws at that level.

The "eediat ting" is voting for, chatting 'bout and otherwise supporting the two parties whose policies or lack thereofover the past 47 years have put Jamaica in the mess it is in.
The "eediat ting" is not seeing the folly of even dreaming that either of the two parties in power will bring about meaningful change.
The "eediat ting" is pimping for these two inept parties even when neither has come up with any sort of published program to change things.

Even the most rabid 'anti-colonialists' in Jamaica (some of whom also happen to be anglophiles in many other respects - paradoxical?), if they're honest, would have to concede that the unbiased detachment of the Privy Council has served Jamaica well. You rightly noted the multi-national make-up of that body. If nothing else, I for one am pleased with their rulings on the death penalty, being a staunch opponent of that barbarity myself. However, I'm not, here, advancing an argument for retaining the Privy Council as Jamaica's final appellate court.

Having the Queen of England as Jamaica's head of state, with the Privy Court as its highest court, are not the reasons Jamaica is in the condition it finds itself. The problems are mainly of Jamaica's own making. Anyone, politician or otherwise, who blame Jamaica's problems on those two factors is worthy of contempt. However, I believe Jamaica should replace the Queen with a Jamaican ceremonial head of state, and replace the Privy Council with a Jamaican final court. These steps would be more consistent with being a sovereign nation.

With respect to the court, I'm aware that some people will be deeply uncomfortable with this idea at this time. Most courts don't even have enough materials, books, law journals, computers, etc; justice is administered in a rather poor environment - some buildings are in need of repairs, no air conditioning, in addition to what appears to be endless backlogs. But these problems can be fixed; it's just that the government has shown itself to be inept at fixing even minor problems. How judges would be appointed, especially at the appelate levels would be much cause for concern. These details can be worked out through consensus - and yes this may still be possible; all is not lost for Jamaica. Ultimatelty we have to build confidence in the ability of Jamaicans to solve its own problems. The entire judicial branch would have to be restructured: courts of original jurisdiction, an intermediary appellate court, and then the Jamaica Supreme Court as the highest court. Currently, there is this really odd arrangement where the Court of Appeals is higher than the Supreme Court, which doesn't seem logical.

For me there is still the matter of the death penalty which would be made easier to impose even if the JLP government were to come to power. The PNP is clearly in favor of it, and now I hear Derrick Smith, the JLP spokesman on national security, saying that a future JLP government would re-instate the death penalty. I used to think that this was one of the issues on which the JLP was superior to the PNP - it was the position of the JLP under the much villified Seaga, and Ossie Harding the former attorney general in the JLP government and later opposition spokesman on justice and also foreign affairs, that the death penalty should be abolished. The JLP had imposed a moratorium on the death penalty in 1987. So now I hear Smith linking the death penalty to improvement in law and order, and I'm thinking he's just repeating the same hollow, bankrupt arguments of the PNP. Now I'm tempted to be in favor of keeping the Privy Council if only for this.

Regarding the head of state, Jamaica could just as well remain with the Commonwealth while being a republic. I'm sure Queen Elizabeth would be relieved; one less pretence to deal with.
