The Jurors are the other party in the trial that are most nervous. How can they...? Can they....?
Whatever they do, they are quite in the limelight and if they go against or for they will be targets.
And Jamaica cannot gurantee their safety, so what will the jury do?

The road restrictions in the vicinity of Downtown Kingston where the trial is taking place has caused traffic to back up as way back as Tinson Pen where the morning traffic out of Portmore bottles up on the Marcus Garvey Drive.
With the recent spate of bad weather which has left the roads in Jamaica worst than any before the Trial has caused additional hardship for commuters in and out of downtown Kingston.

KRAAL TRIAL: DAY 7 - Key Crown witness shies away from testifying

THE DAUGHTER of one of the four civilians fatally shot at Kraal, Clarendon, on May 7, 2003, did not testify yesterday.

The 10-year-old girl, who is a key witness for the Crown, was called to testify but she appeared very shy and would not go into the witness box.

She was taken outside and another witness was called to testify. It is expected that the girl will return to court today.

When the girl was first called into court, the prosecution asked for a short adjournment but Chief Justice Lensley Wolfe asked if there were other witnesses available in a bid to save time.

Randy Risden, 19, welder, of Kraal, was called to the witness stand. He said that on May 7, 2003, he saw a van making "a fast stop" at the gate. He said men came out of the van and as they came out they "start to fire shots".

Risden was testifying at the trial of Senior Superintendent Reneto Adams and five other policemen charged with the murder of the four civilians.

POLICEMEN FIRING SHOTS

The witness said that when he saw the policemen firing shots at the house, two women and two men were on the verandah at that time. He said the four persons ran inside the house when the shooting started.

It was suggested to the witness that he could not see the verandah from where he was at the back of his house, and he said he agreed.

The Crown is alleging at the trial, which began last week Monday in the Home Circuit Court, that the police were not acting in self-defence when 39-year-old Lowena Thompson, 47-year-old Angella Richards, 27-year-old Matthew James and 27-year-old Kirk Gordon were shot and killed.

Adams reports coming under fire from 10 gunmen

The original Dictaphone recording of a radio transmission between former head of the now disbanded Crime Management Unit (CMU), Senior Superintendent Reneto Adams, and police control on May 7, 2003 when four civilians were shot dead by the police in Crawle, Clarendon, was played for the 12-member jury hearing the murder case in the Home Circuit Court, Kingston, yesterday.

On the recording, Adams is heard saying he and members of his unit were fired on by 10 gunmen from a house at Pennants, Clarendon and that the police were returning the fire.

Adams: "Control, CMU 1. Note, we are in Pennants, Clarendon approaching a house; about 10 gunmen have opened fire on us. We are returning the fire."

Adams: "Ask Chapelton (police) to come up to Pennants Road near to the gold mine, some persons have been injured. We want to take them to hospital. Note, a telescopic rifle with telescopic lens, M16 rounds and other ammunition have been found."

Unidentified Voice: "One up, Reneto. That man 'Chen Chen' might be in that group. Good work, supa."

Another unidentified voice: "A wonder whey Mr Perkins a go say? Big up, supa."

Adams: "Control, have you informed Chapelton for assistance?"

Control: "Right sah, same was done."

Adams then calls control several times but gets no reply. Control later replies, explaining that the radio is acting up.
Adams: "Control, some gunmen have been killed. I am asking if the unit has already left."
There is no answer from control.

Adams: "Control, I can't imagine I am not getting you. We need to get these people off to the hospital."
A voice from control responds that the vehicle has already left.

Later, Adams is heard reporting: "Control, another firearm has been recovered; a Taurus magazine and ammunition. I will soon afford you with information."

Control then tells Adams that the vehicle sent to take the people to hospital cannot find him.

Adams: "This is a sad day for them. I am on the road leading to the gold mine area and (they) can't find me. It is a sad day for them."

Adams: Control, could you call me on 399-2798? I am trying to get you on 119 but can't get you."

After the recording was played, technical operator Sergeant Granville Williams, who made the tape, testified that he was fairly conversant with telecommunications systems in the police force for 11 years.

Bureau of Special Investigation head, Superintendent Ezra Stewart, testified under cross-examination that the scene at Crawle was not satisfactorily protected.

"The arrangements for security to protect the scene, in my opinion, were not satisfactory," he told the court, adding that on May 9 when he visited, the scene was unprotected. He nevertheless said he saw a district constable on duty there.

He said police tape should have been placed around the scene, which he considered a crime scene, and about two policemen should have been placed there to protect the scene and ensure that evidence was not contaminated or moved to ensure thoroughness and professionalism.

Exhibits of the four deceased persons' clothing, and bed linen taken from the house at Crawle were not shown to the jury or defence lawyers as Superintendent Stewart refused to open the parcels containing the exhibits.

Chief Justice Lensley Wolfe, who is hearing the case, agreed, pointing out that the words "health hazard" were marked across the polyethylene bags containing the exhibits.

They were, however, accepted in evidence despite strong objections from defence lawyers, who submitted that the prosecution ought to ensure that exhibits are brought to court as non-hazardous items.

Read tomorrow`s papers about testimony given today, Monday by a former police constable who has put new light to the proceedings, by suggesting that Adams got guns from PNP activist, dhanai williams and planted them at the scene of the crime.
This former constb. lives abroad and seems to be protected by Scotland Yard.

A FORMER member of the disbanded Crime Management Unit testified yesterday that he saw Senior Superintendent of Police Reneto Adams planting a firearm and spent shells at the crime scene at Kraal, Clarendon.

Constable Tyrone Brown said the firearm came from an office at Homestead Road, east Kingston, on the evening of May 7, 2003. The firearm was taken to Kraal and handed over to SSP Adams who put it in one of the rooms at Kraal.

The witness was testifying at the third week of the murder trial of SSP Adams and the other five policemen charged with the murder of four civilians at Kraal on May 7, 2003.

Constable Brown told the court that he and other members of the CMU were at Spanish Town and were about to go off duty when a Corporal Ramsay spoke with him.

He said he and other policemen travelled in two unmarked vehicles to a building in eastern Kingston.

The witness said he knew that Danhai Williams (east Kingston businessman) and a man called 'Softie' worked at the office where they went on Homestead Road. He said when they went to the building he remained outside, but Corporal Tingling and Sergeant Ballen went inside. Constable Brown testified that it was close to 6:00 p.m. when he saw a short dark man with metal on his teeth come out and hand Tingling something which appeared to be a firearm.

He said Tingling put it in a yellow paper bag after which they all went to Kraal. He said on the way to Kraal, Tingling got out of the car on two occasions and fired shots from the firearm and collected the spent shells.

When they reached Kraal, he saw SSP Adams and they went into a room where he saw the body of a woman and a rifle lying on the floor. Corporal Tingling gave SSP Adams the yellow paper bag. SSP Adams, in referring to the rifle on the floor, said "See the gun deh weh de dutty boy dem a fire."

SSP Adams went to a room where there was the body of a man. SSP Adams bent down, took the firearm from the bag and placed it on the floor. He (Adams) then picked out the spent shells and threw them on the floor.

Cross-examined by K. Churchill Neita, Q.C., who represents SSP Adams, the witness said he did not give his statements to the police until this year. The witness denied the suggestion that he was lying when he said he saw SSP Adams planting the firearm.

Then there is a test on the credibility of the witness:-

CHIEF JUSTICE Lensley Wolfe yesterday chided defence lawyer Valerie Neita-Robertson for calling a policeman by his alias 'Dutty Dog Brown'.

Mrs. Neita-Robertson was putting suggestions to police constable Tyrone Brown when she said: "I suggest you are not a truthful person, Mr. Dutty Dog Brown."

"Do not do that and you should apologise," the Chief Justice remarked. Mrs. Neita-Robertson pointed out that she had the right to call Brown by his alias because the witness had admitted to her in court that it was his alias.

The Chief Justice said the manner in which it was done was to embarrass the witness.

IMPOSE SANCTIONS

"And if you do it again, I am going to impose sanctions," the Chief Justice warned.

"So be it my lord, but I am entitled to do so," was Mrs. Neita-Robertson's quick response.

Commenting further, the Chief Justice said: "That type of conduct brings the Bar into disrepute."

When Constable Brown, who came into court under tight security, was asked under cross-examination if he was now living in a foreign country, he hesitated.

Prosecutor Terrence Williams said there was an arrangement for him under the Witness Protection Programme and added that the question was irrelevant.

The Chief Justice ruled it was not and when the witness was asked if he was living outside the shores of Jamaica, he said yes. He said he was not employed abroad but he got a subsistence.

Mrs. Neita-Robertson, who was cross-examining him, suggested to him that there had been offers to live abroad and he had taken up an offer and that was the reason he was lying to the court in relation to his evidence.

The witness denied the suggestion.

INCONSISTENCIES

The witness, on being shown his statement of July 1, admitted that it was inconsistent with his testimony in the Home Circuit Court yesterday regarding where SSP Adams was when the firearm in the bag was handed over to him.

It was at that stage that Mrs. Neita-Robertson referred to Brown's alias and said he was not speaking the truth.
