In Jersey, it is perfectly lawful to record a telephone conversation so long as at least one of the participants [in the phone conversation] is aware or made aware of such.

That's (in part) how the law (regarding this issue) reads.

I used to wonder... how does a conversation between two people contain a recorder who IS NOT one of those two.

It finally was explained to me by my (now deceased) father-in-law, a retired attorney and judge and member of the NJ Bar: It is unlawful for a thrid party to record a telephone conversation. That would be an "invasion of privacy".
