Jury question

Any lawyers on the board tonight? I am still on ******* jury duty. [img]/forums/images/graemlins/mad.gif[/img] Still can't discuss the case but I have a question about deliberations -

If evidence is presented that is supposed to show a person is guilty and the same kind of stuff has happened to me before AND I AM INNOCENT, can I use my experience to judge that evidence (as long as it is not prejudice)?

For example, what if they try to prove a person visited a porn website because the computer in their house had cookies from a porn site? If I have never visited a porn website but have found cookies from porn websites on my puter, can I use the fact that it happened to me to have reasonable doubt that the defendant visited porn sites?

My house is in my name only, the computers were registered to me, all utilities including cable are paid for by me. There is no record of anyone else living with me because everything is in my name - but several people have lived with me in the past and currently. Also even more people have visited and used my computer - one without my permission. [img]/forums/images/graemlins/mad.gif[/img]

I picked up all kinds of horrible stuff through an ad that ran here. britisha suffered from the same intrusion, if memory serves. Stuff can get into your computer through pop-ups etc.

One of the important rights afforded a criminal defendant under our system of justice is the right to a fair trial before an unbiased fact-finder. But ours is a human process, and just as there are no “perfect” trials, there are no “perfect” juries.

While the goal is utter impartiality, each juror inevitably brings to the jury room a lifetime of experience that will necessarily inform her assessment of the witnesses and the evidence. This is a reality we simply cannot deny. Nor would we want a jury devoid of life experience, even if that were possible, because it is precisely such experience that enables a jury to evaluate the credibility of witnesses and the strength of arguments. What we can - and do - ask, however, is that every juror enter the trial with an open mind, that every juror not be prejudiced from the outset against any particular party, and that every juror be willing to decide the case solely on the evidence presented and the law instructed by the Trial Judge.

Your deliberations should be characterized by a free and fearless expression of your own opinions and patient, tolerant attention to the opinions of others. While you must base your decision upon the evidence presented in the case, you should also keep in mind what the judge may have said about weighing the evidence, how to decide what evidence to believe, and the burden of proof.

I am officially a free woman! The jury was deadlocked and the judge finally called a mistrial and sent us home. Suss report to come.

R+ this jury almost got to the point of fisticuffs. It got persoanl and very ugly until the judge finally decided she was through with us.
