Morph...the said businessman and his partner entered into a deal....with one of enron's executive...fastow....and earned millions of dollars..they essentially deceived Natwest ..

anyway....it was Natwest that lost millions and decided NOT to bring charges against these 2 men...why ? so that consumer confidence in natwest can continue strong...

they are also charged with wire fraud...

back to Natwest....that blasted bank did not do enough due diligence....how could they have missed all a that ? shareholders need to hold the bank accountable ....a dat's why them nuh charge the 2 men...dem nuh want mek a big stink about it...and yuh see seh the guy dem a beg the bank fi investigate dem and all now the bank naw study dem... Well the same can be said for ALL the banks including online banking. NO bank is 100% fraud or theft proof! They all cover up their vulnerabilities in order to appear secure in the eyes of the public. Would you stick your money in a bank if you felt its security was weak?

You mentioned that the Scottish guy and others are not being investigated despite calls to do so. They would, if it was in their interest or they won't if there isn't enough evidence to prosecute. Can't go to court on hunches and gut feelings, hard overwhelming evidence is required and these guys working in the sector knows the system and knows that if they were going to defraud Natwest or any other institution the idea would be to leave no incriminating evidence to stop them enjoying their spoils.

Then there is the situation as mentioned above of covering up the incident as not to knock shareholders and creditors confidence, not to mention the effect it would have on stock market prices for the company. Then there is the legal right to a fair trial; regardless of how guilty a person is or appear to be, they are entitled to a fair trial. It is strongly felt that, as a separate issue from whether they are guilty or not, that being prosecuted in america will not yield a fair trial but a scapegoat.

Besides, did they actually defraud or stole money from Enron or was it Natwest? Did the alleged crime occur in america or britian? If it is the latter answers, then rightlfully they should stand trial under british law in british courts and not in america. If Enron feels genuinely, that they have been wronged, why not gather their top international lawyers and come over and present their case. Does Enron feel the trial in britain won't be fair or do they think british law is not good enough for them. I am sure Enron isn't short of top lawyers for just about every country they do business in. Why the need to extradite? This extradition moves are normally used by goverments and large international companies when they want to convey a message to the accused...

If a person has a Jamaica TRN card do they have to provide the bank in Jamaica with their US social security number?

No, the majority of jamaicans do not have a US social security number,but all that do any business are required to have a TRN. You need a US social only if you do not submit a local means of earning,or you wish to transfer funds from the USA..

The men above say they are innocent and should be tried in the UK, but the attorney general has rejected calls for the three British bankers wanted by the usa over the collapse of energy giant Enron to be tried in the UK.

They are accused of selling Enron for less than it was worth??? I guess that mean I could sue my valuators if they value my house for less than it was worth too; even sue the estate agent for advertising and selling my house for less than it is worth. the way it was reported months ago...made it seem like they defrauded Natwest...it's only in the past week that I read where the company at the center of it all ...was indeed a subsidiary of Enron....so now mi can see why the US a guh after them...there is a powerful group ...on behalf of the Enron ex employees .....that is pushing for this to happen...


and sad to say ...the govt. nah guh just ignore it suh....

of course....plain and simple is the fact that when they convince Natwest to sell the company for little and nothing...Natwest did not perform any sort of decent "due dilligence" on the subsidiary to see what exactly it was worth....

however....being that the 3 men worked for Natwest [img]/forums/images/graemlins/confused.gif[/img] I suppose Natwest trusted their word that the company was actually only worth let's say 1 million...

the men then joined forces with enron executives to partner and subsequently sell the sub for 30 million...that's just plain wrong right there....

I mean to go from selling for a small sum to selling again for a significant larger sum...there had to be significant "value" added to the subsidiary for the period of time following the sale by natwest [img]/forums/images/graemlins/confused.gif[/img] and I don't see it ...so it must have been undervalued when sold...mi a guh try pull up the 10Q fi see what happened...

well put it this way...many foreigners come down to manhattan to file lawsuits all when dem nuh live in the US ...so I guess since Enron is a US company them can file suit in the US ...as opposed to Britain

Does your valuator value your house or sell it at ridiculously low price,only to have the buyer re-value it at the real price and use it as collatoral to rip of innocent investors?
These men were not independent valuators,they worked for the company,and fraudulently,act as if they were representing the company they were working for,while they were actually acting against it's best intrest.
That is illegal.

What's causing the concern that I've seen in non-US media of different countries is that USA extradition laws don't work both ways. Check BBC News for one, claims this extradition business was set up for mainly terrorism related stuff, which I've heard before, in this & other cases. But the US doesn't reciprocate. Not at all, from legal matters I've known the details of from work.

I see your point doc but the row goes on and the latest twist are in the links below. USA is yet to ratify this extradition law and as it stands if they don't do it soon then Britain may well tear up the agreement and have the law in Britain changed as at the moment it is one sided.
