Sounds like typical 3rd generation welfare recipient antics to me I've known women who have messed up their children's credit long BEFORE the age of 18.

Don't know the specifics of &quot;how&quot; they do it, but I know it's a common practice

Last weekend a woman called on the Suze Orman show...telling Suze seh har moddah took out credit in har name and defaulted an mess up har credit...blah blah blah...finally Suze asked her if the mother owned a house/property...the daughter/victim answered that she did..

Suze juss tell har fi go place a lien on the property....juss like dat. dat wi teach di Mumma.

The reports have arrived (well 2 out of 3) and it look like BabygirlA has defaulted on:

1 American Express
2 Macy's
3 M&amp;T Bank
4 Orchard Bank
5 Target

From what mi can read all of the cards have original balance that is lower than what is now owed. which mi gwine assume is fees. All but Target say they've been charged off. Mi nu even know wah daht mean cah the balance still say it not paid. The accounts were open before BabygirlA came to live with us. The amounts on some of these are a lot (especially the AMEX).

BabygirlA want to know what she should do. mi nu even know what fi tell har. she coming home this friday coming. sigh.

Step 1: Tell the consumer reporting company, in writing, what information you think is inaccurate. Include copies (NOT originals) of any documents that support your position. In addition to providing your complete name and address, your letter should identify each item in your report you dispute; state the facts and the reasons you dispute the information, and ask that it be removed or corrected. You may want to enclose a copy of your report, and circle the items in question. Send your letter by certified mail, “return receipt requested,” so you can document that the consumer reporting company received it. Keep copies of your dispute letter and enclosures.

Consumer reporting companies must investigate the items you question within 30 days — unless they consider your dispute frivolous. They also must forward all the relevant data you provide about the inaccuracy to the organization that provided the information. After the information provider receives notice of a dispute from the consumer reporting company, it is required to investigate, review the relevant information, and report the results back to the consumer reporting company. If this investigation reveals that the disputed information is inaccurate, the information provider has to notify the nationwide consumer reporting companies so they can correct it in your file.

When the investigation is complete, the consumer reporting company must give you the results in writing, too, and a free copy of your report if the dispute results in a change. If an item is changed or deleted, the consumer reporting company is not permitted to put the disputed information back in your file unless the information provider verifies that it is accurate and complete. The consumer reporting company also must send you written notice that includes the name, address, and phone number of the information provider. If you ask, the consumer reporting company must send notices of any correction to anyone who received your report in the past six months. You also can ask that a corrected copy of your report be sent to anyone who received a copy during the past two years for employment purposes.

If an investigation doesn’t resolve your dispute with the consumer reporting company, you can ask that a statement of the dispute be included in your file and in future reports. You also can ask the consumer reporting company to provide your statement to anyone who received a copy of your report in the recent past. You can expect to pay for this service.

Step 2: Tell the creditor or other information provider, in writing, that you dispute an item. Be sure to include copies (NOT originals) of documents that support your position. Many providers specify an address for disputes. If the provider reports the item to a consumer reporting company, it must include a notice of your dispute. And if you are correct — that is, if the information is found to be inaccurate — the information provider may not report it again.

<span style="font-weight: bold">You need proof</span>

Decide whether or not to contact law enforcement. &quot;This of course may involve turning in one's grandmother. Depending on the relationship, this may 'cost' more than the actual debt in more ways than one,&quot; says Robert Siciliano, McAfee consultant and identity theft expert.

File a police report citing identity theft. Evidence can be signatures not matching or charges made when the victim couldn't have possibly made them.

Once a police report is filed, the process of mitigating &quot;new account&quot; fraud begins. It is more important to prove that the victim did not make the charges than to prove who made the charges.

<span style="font-weight: bold">But remember, if you fail to file a police report, you will appear responsible for the charges</span>.

<span style="font-weight: bold">Dealing with the credit card company</span>

Notify your credit card issuer to shut the card down so that the fraudulent charges cannot continue. The credit card company will request that you send a signed affidavit and a copy of the police report.

You need to take steps to document the questionable purchases. Creditors expect to get paid. By proving that you did not make the charges the debt can be forgiven.

Discover Card and other issuers will work with the merchants, where the alleged fraudulent activity occurred, to request receipt details. Once all of the necessary information is in the hands of the card company, they review the evidence and make a determination.

<span style="font-weight: bold">Dealing with a collection agency</span>

The credit card company may have already sold off your debt to a collection agency whose sole purpose is to collect money from you. To stop their pestering, you will also need to send the collection agency an affidavit and copy of the police report.

The collection agency's next steps would be to indicate that the account is in dispute, inform the credit bureaus of this and begin their investigation.


<span style="font-weight: bold">How to re-build your credit score</span>

However, since they process so many collections, they may not respond to your notification of fraud and you may choose to file a Fair Debt Collections Protection Act (FDCPA) lawsuit to stop their actions, according to Ulzheimer.

The credit bureaus
The fact that you have been late in your payments, however fraudulent the charges were, has been reported to the three credit bureaus. They are housing, maintaining and possibly disclosing incorrect information about you.

You will want to add a fraud alert to your credit report and have the erroneous information purged from your file. Once again, you will be asked to furnish an affidavit and a copy of a police report.

Going forward, it's a good idea to be sure to review your credit report and report any unfamiliar activity, as well as regularly monitor account activity online

Foley also has a guide on her Web site for those whose parents have stolen their identities. Among her suggestions:

<span style="font-weight: bold">Consider filing that police report</span>. Taking what seems like a drastic step may be the only way to get your credit cleared -- and to drive home to the perpetrator the seriousness of what he or she has done. Im a believer in tough love, Foley said.

<span style="font-weight: bold">Try mediation</span>. A few victims who were unwilling to file crime reports but who had remorseful parents have been able to get their names removed from credit accounts those parents established. Using an attorney mediator, they had their parents draw up an agreement acknowledging sole responsibility for the account, Foley said.

An attorney mediator is an additional cost, but you show good intent that way, Foley said. A local bar association can provide referrals to mediators.

But credit issuers typically wont accept such agreements without a significant payment toward the debt. And this assumes the account hasnt been charged off or sent to collections, which significantly reduces the creditors interest in cooperating.

<span style="font-weight: bold">Consider changing your Social Security number</span>. This is a drastic and difficult step, one that the Social Security Administration typically discourages. Its not a good solution if you have a significant work or credit history that you could lose in the change-over. But if youre young and just starting out and you can keep the new number a secret from your parent, it could be one solution. The Social Security Administrations Web site has information about getting a new number.

<span style="font-weight: bold">Be vigilant about your credit reports</span>. Heres one case where investing in credit monitoring might be a smart idea. At the very least, have fraud alerts put on your credit reports at all three major bureaus: Equifax, Experian and TransUnion. Unfortunately, lenders often ignore fraud alerts, but theyre still worth trying.

If youre a California resident, you currently have the right to freeze your credit, which should prohibit anyone from opening an account in your name. (It takes a secret personal identification number, which only you know, to unlock your report so that credit can be granted.)

<span style="font-size: 14pt">Expect some emotional fallout. </span>Common reactions to identity theft include feelings of rage, betrayal, isolation and financial insecurity -- emotions that are often amplified when the thief is a parent. Getting therapy can be helpful, as can talking to supportive friends, a clergy member or a support group.

The emotional toll is very deep, Foley said. It can be permanently scarring.
