OK, I am really confused...

Did the man not have sex with his wife while she was unable to physically decline? She was sleeping...if she is sleeping she is physically unable to tell her husband to stop.

He did do exactly what you have posted. According to what YOU have posted...what he did is sexual abuse or rape in the 2nd degree (if you live in Maryland).

The statute that you posted contains the conjuction or and not and. Which means that her husband was brought up on the charges because he did one of the 3 items in the statute that you posted. The conjuction and would imply that all 3 would have to take place in order for it to be considered a crime. But the statute you posted contains the conjuction or, which means any of the 3 can take place and it be considered a crime. He did the last part of the statute, which is why he was arrested in the first place.

I agree with you that no he didnt threaten her, no he didnt use any fear tactics (from what we have read) but he did do the latter of the statute that you posted, which is why he was charged.

Now to address the she woke up during an a deh suh she decline. That makes his case even worse...she told him NO...and the behavior continued.

If these circumstances had been a boyfriend, or some dude that she knew, but was not romantically involved with...I dont think there would be much of a discussion because we would all agree that she was being raped. But the circumstances in this case are not as such, so here we are.
