Well championgal, you are partially right. Under the Child Citizenship Act, the child would automatically become a citizen. Her attorneys in the adoption process should have taken care of this.

that attorney was not too bright. What needs to be done now to finish this process with immigration?

I don't know if Ochigal is still on line, but if she is in the states, she can't petition for the father of her child if they aren't married, and her child would be too young to file for him.

Asham, that is defintely not true. As a U.S. citizen, an individual has the fundamental right to travel. This means that they can leave the country for years at a time if they so choose. Of course, permanent residents can't leave as often because they risk losing theire green cards.

Your friend needs to find an attorney to file the necessary papers before the child gets older.

Can I attempt to assist my babyfather in any way...would sending him an invitation letter cause more harm than good in the sense that he would then look like a possible "flight risk"?

This is a question I get all the time. The consular office has sole jurisdiction over who gets a visitor's visa and who doesn't. My understanding is that they are declining applications left right and center. Unfortunately, there isn't much that can be done.

Not difficult at all. When born in Jamaica, you will always be recodnized as a jamaican citizen. Although, upon becoming an U.S. citizen, an oath is taken revoking all citizenship, it is actually meaningless because the jamaican born individual, will always be recognized as a citizen.

Yes, this is soooo true. I had a former employee who made very little money, no assets what so ever, and an invitation letter from his brother saying "life here is good". He got a Visitors Visa without a problem.

My babyfather, was turned down with a huge folder of documentation, they didnt even look at.

It all depends on the mood of the interviewer and whether or not he/she likes your looks.

I am joining a little late but enjoying the thread. I have a question about the opposite move. I am a US citzn planning to move to Jamaica to work as a nurse practitioner. I will hopefully be working for the Ministry of health. Can I make this move as soon as I secure the job or is there a work permit process that i need to follow. I have been told that if I work for the JA gov't, I will not need a visa. True? [img]/forums/images/graemlins/confused.gif[/img]

To be honest, I'm not able to answer that question, because I'm a U.S. immigration attorney, and only handle immigration to the U.S. But, from what I know, you probably would need a work permit to work in Jamaica.
