WASHINGTON — The Supreme Court has turned down an emergency appeal from a New Jersey man who says President-elect Barack Obama is ineligible to be president because he was a British subject at birth.

The court did not comment on its order Monday rejecting the call by Leo Donofrio of East Brunswick, N.J., to intervene in the presidential election. Donofrio says that since Obama had dual nationality at birth _ his mother was American and his Kenyan father at the time was a British subject _ he cannot possibly be a "natural born citizen," one of the requirements the Constitution lists for eligibility to be president.

Donofrio also contends that two other candidates, <span style="font-weight: bold">Republican John McCain and Socialist Workers candidate Roger Calero, also are not natural-born citizens and thus ineligible to be president.</span>

At least one other appeal over Obama's citizenship remains at the court. Philip J. Berg of Lafayette Hill, Pa., argues that <span style="font-weight: bold">Obama was born in Kenya, not Hawaii as Obama says and the Hawaii secretary of state has confirmed.</span> Berg says Obama also may be a citizen of Indonesia, where he lived as a boy. Federal courts in Pennsylvania have <span style="font-weight: bold">dismissed</span> Berg's lawsuit.

There may have been a bigger objective behind the lawsuits, ie, to get rid of &quot;standing&quot; - showing how you stand to be 'injured' by some action/decision that you are asking the court to set aside. The courts have ruled repeatedly that to show standing means more than just being a voter or a taxpayer.

If standing is abolished (which no rational court will do), then fiscal conservatives and right-wingers will seek to overturn any spending and tax policy or bill that they oppose with lawsuits, which will effectively 'jam' the system and bring government to a halt.

This, I believe, was the larger purpose of these lawsuits, because surely they should know that their case was pure BS. But do you recall who decided to accept the case for review? Clarence Thomas. A slap at Biden for giving him hell back in '91? Maybe.

I am not surprised at these attempts to sew discord at this late stage in the game hoping to get lucky that one of their &quot;hair brain&quot; challenges may find favour with some &quot;cukoo type&quot; judges to &quot;gum up the works&quot;... These people are &quot;sick racists&quot; who will stop at nothing to perpetuate their brand of bigotry... It's time for them to GET OVER IT!! or eventually become INSANE! if they dont seek HELP...
