The "Django Unchained" actress who claimed she was harassed and hurt by cops after making out with her boyfriend was actually rooksin in her car according to witnesses ... then went on a rant with cops accusing them of racism and not knowing who she was ... according to police audio obtained by TMZ.
Daniele Watts had just left CBS studios in the San Fernando Valley around 2 PM Thursday. She says she was making out with her BF, but we've learned witnesses from the nearby Art Directors Guild office building told cops they were watching her and her BF rooksin full-on in the passenger seat WITH THE DOOR OPEN!
The eyewitnesses said the guy was sitting in the seat, she was straddling him and it was for everyone to see. One eyewitness told cops they cleaned themselves up afterward with a tissue.
TMZ obtained police audio of the incident. Watts instantly plays the race card when Sgt. Jim Parker asked for her ID. She quickly moves from the race card to the fame card -- then storms off, refusing to show her ID.
While Watts was gone, Sgt. Parker had a very cordial conversation with her BF Brian.
She was apprehended by another cop a short distance away and brought back -- and things got NUCLEAR!
Some of her choice comments:
- "I think I'd like to identify you ... to my publicist."
- "I serve freedom and love. You guys serve detainment. That's cool."
- "I hope when you're rooksin your spouses you really feel alive."

Daniele Watts, ‘Django Unchained’ actress allegedly mistaken for prostitute, heard arguing with police in audio
The Los Angeles Police Department addressed the incident Sunday, saying that its officers responded to a caller complaint that a male and a female were involved in indecent exposure inside a Silver Mercedes 'with the vehicle door open.'
Daniele Watts, the actress who claims she was wrongfully detained and handcuffed by Studio City police for making out with her boyfriend, argued cops had no right to demand her identification when they stopped her on Sept. 11.
In audio from the incident obtained by TMZ, Watts is heard arguing with the arresting officer as he repeatedly asks to see her ID. CLICK HERE TO LISTEN TO THE AUDIO (WARNING: EXPLICIT LANGUAGE).
“Do you know how many times the cops have been called ... just because I’m black and he’s white,” she’s heard saying.
The officer accuses Watts of bring up the “race card,” saying he was called by neighbors in response to a lewd scene.
“I have every right to ask your ID,” the officer says, as Watts protests.
The actress, who has also appeared on "Weeds" and "Partners," took to her Facebook page Thursday to share her experience — which she believes was the result of prejudice against her being black with a white boyfriend. Watts posted photos that her beau, Brian Lucas, took as she stood handcuffed and crying.
Witnesses from nearby buildings apparently told police they saw Watts and Lucas having sex in the passenger seat of their car, according to TMZ.
“Today I was handcuffed and detained by 2 police officers from the Studio City Police Department after refusing to agree that I had done something wrong by showing affection, fully clothed, in a public place,” she wrote.
“From the questions that (the cop) asked, I could tell (he) thought we were a HO (prostitute) and a TRICK (client),” Lucas added on his own Facebook page.
Watts said she was talking to her father and standing by a tree when the police came. She’s heard telling her father to “hold on” as she talks to the officers in the audio release.
She is also heard telling the cops that she “has a publicist” and works as an actor in the studio nearby.
“I am going to say no,” she tells the cop who repeatedly asks for her ID. “And you can say that I’m resisting arrest.”
The officer responds saying Watts was “interfering” rather than resisting arrest and that he had probable cause to ask for identification because of the complaints from neighbors.
The law in California, and in New York, has no statute requiring individuals to present identification when detained on suspicion of criminal activity.
The officer is heard requesting a female officer be brought to the scene in the audio tape, after protests from Watts continue.
“We’re going to get your ID one way or another,” he says. “Thank you for bringing up the race card I never hear that.”
Watts is later heard crying and yelling as her boyfriend has a conversation with the officers. Lucas, a celebrity chef, explained that he presented his own ID without conflict "because of his past experience with the law."
“I was sitting in that back of this cop car, filled with adrenaline, my wrist bleeding in pain, and it occurred to me, that even there, I STILL HAD POWER OVER MY OWN SPIRIT,” Watts wrote on Facebook.
“I knew that I had done nothing wrong, that I wasn’t harming anyone, so I walked away."
The Los Angeles Police Department addressed the incident Sunday, saying that its officers responded to a caller complaint "that a male and a female were involved in indecent exposure inside a Silver Mercedes with the vehicle door open," according to a statement obtained by the L.A. Times.
Officials located "two individuals that matched the description of the suspects," and they were briefly detained.
"Upon further investigation it was determined that no crime had been committed," the statement continued. "Ms. Watts and her companion were subsequently released.”
The LAPD has also launched an internal complaint investigation, officers told The Times.
Watts maintained her innocence in an interview with CNN Monday.
The actress maintained that she did nothing wrong, emphasizing that she and Lucas were "fully clothed" and within their rights to show affection publicly. She also claimed the police officer first approached Lucas for her identification.
"He didn't even give me the respect of telling me what happened," she told CNN. "For me, if he would have come to me like 'excuse me ma'am, you seem like a respectable person but someone made a call can we just talk to you for a second,' the whole situation would have been different."
Watts also maintained - knowing that the situation could have been resolved much earlier if she would have presented her ID as asked - that she didn't because she believes "in America and what it stands for."
"Part of my role as a public figure is to raise awareness and be strong enough to say and do the things that people that maybe don't have the advantages that I have...or aren't strong enough, or don't have the know how, or don't have the awareness to do" she said.
"For me standing up for that constitutional right was a gift and a blessing."

Sgt. Jim Parker refutes the account of the actress, contending that he recorded the incident from the moment he got out of his car
The Los Angeles police officer involved in a confrontation with Django Unchained actress Daniele Watts is emphatically defending himself against any charges of wrongdoing.
"She is lying," LAPD Sgt. Jim Parker tells The Hollywood Reporter, contending the actress is making "malicious and false statements."
Watts, who is African-American, says the police accused her of prostitution because she was being publicly affectionate with her white boyfriend, Brian James Lucas.
“Today I was handcuffed and detained by 2 police officers from the Studio City Police Department after refusing to agree that I had done something wrong by showing affection, fully clothed, in a public place,”Watts wrote on her Facebook page on Thursday. "When the officer arrived, I was standing on the sidewalk by a tree. I was talking to my father on my cellphone. I knew that I had done nothing wrong, that I wasn’t harming anyone, so I walked away. A few minutes later, I was still talking to my dad when 2 different police officers accosted me and forced me into handcuffs," adding that her wrists were "bleeding in pain."
But Parker refutes Watts' account, saying he was already near the location to meet up with two other LAPD officers at Starbucks when he got a call about public nudity at the corner of Radford Avenue and Ventura Boulevard, near CBS Studios. Parker tells THR that he recorded the incident from the moment he got out of his car to when it ended.
"They were Rooksin. He was in the passenger seat with his legs outside," Parker says, paraphrasing a call from someone at the Art Directors Guild office, complaining about employees watching a couple having sex in a car in broad daylight with the door open, complete with a description of the make and license plate of the car and description of the couple and what they were wearing. He says at least one witness took a photo. "People don't make this EDIT up."
Parker says he didn't plan on arresting the couple, who he says were no longer engaged in intercourse, and standing outside the car; she was on the phone. "People having sex in the car, no biggie. No one wants to arrest anybody," Parker says. "And he [Lucas] said, 'Oh, I have her passport.' He was wearing two tourist bags around his neck and I assumed he had hers. She was feigning disinterest, but I could tell she was listening in. Then as you hear on the recording, she starts making a fuss, and quite frankly I don't need to see her ID but she does have to ID herself."
The recording, which was made public by TMZ on Monday, features a woman's voice saying, "Do you know how many times the cops have been called because I'm black? Just because I'm black and he's white?" Later, she says, "You can say I'm resisting arrest," and put her father, who she was speaking with on her cellphone, on speaker to talk to the police, saying, "It's my right to stand on the street corner and make out with my boyfriend."
But cops say they were doing more than making out.
"There's no resisting; you're just interfering," a policeman is heard saying. LAPD sources tell THR that TMZ's recording is authentic.
Parker says he knew the other officers were nearby when Watts walked away from him as the situation escalated, but he didn't want to chase after her or physically confront her. "I've been here before, I'm not touching her. I don't want to be accused of anything. So I requested a female officer and said, 'Hey guys, grab that female on the phone and bring her back to me.'"
"I'm thinking, 'God, it's taking a long time to bring her back to me,' Parker continues. "They [two other officers] said, 'She's being difficult.' They have her handcuffed, because that's what they do. It's too far to walk, so they drove her back. And I said, 'You have to give me your ID or tell me your name.' She's crying."
Watts, who is also on the FX show Partners, told CNN on Monday that the LAPD "accosted me and forced me into handcuffs," and repeated what she had said on the recording, that the cops alleged "I had done something wrong by showing affection, fully clothed, in a public place." She also told CNN she felt disrespected when police asked Lucas for her ID instead of asking her directly.
"She had no idea I was recording. So I asked her, 'Why are you in handcuffs? He's [Lucas] been here this whole time not in handcuffs. Tell me if someone has been disrespectful,'" Parker says he asked the actress when she returned, handcuffed and distressed, adding that the recording exonerates the LAPD in this situation. "Police officers can record surreptitiously without consent. The other officers also had their recording on. It helps the police department."
The LAPD confirmed it is conducting an internal investigation because of the widespread publicity surrounding the incident. If he hadn't made the recording, Parker says, "The three of us would be relieved of duty right now."Comment
