I thought saved by the bell refer to the boxer in the ring who gets saved by the ringing of the bell before the opponent finish him off.

NY man demands estranged wife pay him for kidney

GARDEN CITY, N.Y. — A Long Island surgeon embroiled in a nearly four-year divorce proceeding wants his estranged wife to return the kidney he donated to her, although he says he'll settle for $1.5 million in compensation.

Dr. Richard Batista, a surgeon at Nassau University Medical Center, told reporters at his lawyer's Long Island office Wednesday that he decided to go public with his demand for kidney compensation <span style="font-style: italic">because he has grown frustrated with the negotiations with his estranged wife.</span><span style="font-weight: bold">
He claimed he has been prevented from seeing their children, ages, 8, 11 and 14, for months at a time.</span>

&quot;<span style="font-weight: bold">This is my last resort; I did not want to do this publicly,&quot; Batista said.</span>

He said he gave his kidney to Dawnell Batista, now 44, in June 2001. <span style="font-weight: bold">She filed for divorce in July 2005, although he claims she began having an extramarital affair 18 months to two years after receiving the kidney trans</span>plant, his attorney, Dominick Barbara said.

Douglas Rothkopf, the attorney representing Dawnell Batista, did not return telephone calls seeking comment.

Matrimonial attorneys were quick to shoot down any possibility Batista would succeed.

&quot;I've been in this business over 40 years and I've never heard of that,&quot; said Seymour J. Reisman, a Long Island divorce lawyer. &quot;It's not marital property, not a marital asset you can put a price tag on.&quot;

Manhattan attorney Susan Moss said, &quot;The good doctor is out of luck and out a kidney. This is similar to cases where a husband wants to be repaid for the cost of breast implants and the such. Our judges are not willing to value such assets, so to speak.&quot;

Batista, 49, said he has no regrets about donating the kidney, only about the failed marriage. The couple was married in 1990 and lived in a million-dollar home in Massapequa. They met while he was working at a hospital and she was training to be a nurse.

He still recalls the day after the surgery took place.

&quot;There is no greater feeling on this planet. As God is my witness, I felt as if I could put my arm around Jesus Christ. It was an unbelievable; I was walking on a cloud.

To this day I would still do it again.&quot;

<span style="font-family: 'Courier New'">Dawnell Batista doesn’t want to be talking to a reporter.
She’s in the middle of what will forever be known as the Kidney Divorce, and she is an amazing woman who’s been betrayed both by her body and her husband.

Her split from Dr. Richard Batista has been painful enough, dragging on for four years, and mostly, she’s been worried about the children.

But just as their trial was about to begin, the surgeon upped the ante. His lawyer Dominic Barbara, a Howard Stern regular, announced that Dr. Batista had donated a kidney to her, and now he wants it back — or its supposed $1.5 million value. He covered the Earth with press like the old Martin’s paint logo, even going on Larry King.

“Now the paparazzi are outside our house,” Dawnell says somberly. “My children are afraid to go into the bathroom for fear their picture will be taken through the window.”

It’s a reality show she didn’t want to be in, but neither does she want what she says are lies to be blasted out to the world undefended.
She’s had three kidney transplants and a double mastectomy. She’s raising three kids alone and has gone back to work as a nurse. You think she’s not strong?

“It wasn’t a happy marriage from early on,” Dawnell, wearing a modest turtleneck and blazer, said.
“Still, we were together. You always hope for change. You always hope it’s going to get better.”
It was not to be. The turning point, she said, came one night in June four years ago when her phone rang.

As she tells it, she had spent the afternoon in a long marriage counseling session with her husband, despite feeling weak from surgery and being bandaged and bound.
“I’ve got to get out of here,” her husband had said, leaving abruptly after the therapy. “I’m stressed out.”

Days before, she’d had her chest opened up again to remove the expanders surgeons insert after a double mastectomy. But it was her heart that was about to take a hit.
Dawnell picked up the phone. It was a close friend.
“I’m in a restaurant,” the friend said. “Richard is here. He’s with a young woman.”

Dawnell’s friends sprang into action like a SWAT team. Two went to her house; one to watch her three children, one to set out in the car with her, one to keep watch in the eatery.
By the time they got there, the doctor and his companion had left the restaurant. Dawnell’s pal followed them, all the while giving Dawnell directions.

Dawnell arrived at the strange house and saw her husband’s truck in the driveway. It was nearly midnight and the lights were off, but she went up to the house and rang the bell....</span>

The woman answered the door, and Dr. Batista was behind her. Dawnell asked the woman if she knew he was married. She didn’t; he’d told her he was divorced. It wasn’t true — yet.


Dawnell filed for divorce the following week.


She believes it was divine intervention. “I’m a spiritual person,” Dawnell said. “Thank God my friend was in that restaurant.”


Dr. Batista had had jealous fits of rage through the years over Dawnell, who, even after all her health battles, still resembles Cindy Crawford. She said she was always faithful.


“I know my truth,” she said.


Barbara didn’t return calls. Dr. Batista told Larry King his reason for divorce was “infidelity.” He didn’t say it was his own.


Dawnell starts to cry when she thinks about how the publicity has affected her children. Her eldest daughter, bright enough to have skipped a grade, went online, and the first thing she saw was her mother’s face. Under it, a blogger suggested Dawnell should be hurt with a scalpel.


This is a couple who did an incredible thing together. When Dawnell learned in 1999 that she was pregnant with their third child, she was told her kidney, donated by her sister, would probably fail.

my ex nabes were togedda fe several yrs..she needed a kidney..he gave her one of his..den they got married..den about 4 yrs later they got divorced..i don't know what the circumstances were surrounding the divorce..but at the time I wondered if im nu feel aways bout giving her that kidney now..i think I posted about it in DK at the time
