is a subtle ting based more on practise dan anyting i believe...the wording of the ammendment is such,dat him ha di title but widdout di oath, him cannot carry out the functions of di title

so since Biden had taken his oath , he was defacto prez fi dat time...afta all the office of the presidency cannot be unattended fi even a moment...so Biden can claim to be president in its totality fi a minit...cause he is next in line if di pres not in office and he wasnt technically able to execute his duties, Obama , dat is, widdout the oath...
