Re: new Prez's fuss Supreme Ct appointment ???????
Very likely. Both Ginsburg and John Paul Stevens are believed to retire soon. Rumor has it that they were holding on for a democrat to occupy the White House. Ginsburg's husband has been ailing for some time, so that will make her departure even more likely.
Jeffery Toobin wrote that David Souter almost quit the Court in anger and disgust after the 2000 selection of GWB by the conservative block on the Court. He was persuaded to stay on. He hates Washington and wants to go back to New Hampshire.
The justices likely to be replaced will be those from the liberal block, unless Alito or Thomas, or Scalia (or all three) should suddenly be diagnozed with advanced prostate cancer or something imminently life-threatening. So Obama will be just replacing liberals for more liberals, which is still better than if McCain had become president.
I think Obama should put a qualified hispanic woman on the Court.

whose names can u see on a shortlist?
</div></div>
I came across a Jennifer Martinez, hispanic woman, professor of law at Stanford law school. She is a constitutional scholar, human rights lawyer, she defended Jose Padilla in Rumsfeld vs Padilla when the case went before the Supreme Court, she is against military tribunals, unitary executive, etc.

Obama may have to fill up to 3 SC vacancies in the next four years. Still, Ginsburg hasn't officially resigned from the Court. How long she remains may depend on her treatment, and if her husband's condition worsens.
Stevens is the oldest and most liberal member of the court (he got more liberal with age; he was appointed by Nixon). He wants to retire, but would hate to be replaced by a conservative. Soutie (David Souter) a brilliant mind, is known as the "stealth justice." GHW Bush nominated him, on the recommendation of some prominent conservatives who swore he was one of them. When he got on the court, he was the opposite of what they thought he would be; he became one of the most liberal/progressive members of the court. When GHW Bush listed some of his mistakes during his presidency, he often pointed to Souter. He lives an almost ascetic life: thrifty, a bachelor, lives in a one bedroom apartment in Washington, doesn't own a tv, doesn't use cell phones.
