What offends me is the diversion from the JLP failure to combat crime. Just goes to show how stupid you are because you sight up the same thing that the JLP has no capacity to fix the Crime Spree.

You shouldn't use words you don't understand. The &quot;buggery&quot; law may be on the books, but it is <span style="font-weight: bold">unconstitutional</span> because it violates a constitutional right - the right to freedom of association. That law does not rest on any solid legal reasoning. I have already stated above the reason the law remains on the books, not because it currently passes any constitutional muster. If politicians chose not to abolish it, the Court should assert its powers of judicial review. But we are talking about Jamaica here. Smith's argument is shallow. He said the gay rights group is advocating the breaking of the law, yet he fails to consider the constitutional soundness of the law in question. No intelligent person will take him seriously, only people looking to feed their prejudices. In the same breath, he made an assertion but couldn't not provide any evidence for said assertion. Imagine having this man representing you in case before the courts. I shudder at the very thought.

I'm not advocating for anything other than the right of consenting adults to be left alone in their private domain. If people of consenting age agree to stick their private parts into an area meant for defecation, it's neither mine, nor Earnest Smith's business. I can think of a number of things I would like to outlaw because they offend me, but civilized societies don't work that way.

The type of killing that the Peta Queen trial represent is rare. The arrest and conviction of Jamaican Offenders for murder is also rare, hence the crime problem. Neither you or fool-fool MHR Earnest Smith presented one shred of evidence that homos are any more disposed to violence that the average Jamaican and the it all the point that needs to be made.

OK, either you are slow, or you lack basic comprehension skills. I want you to read all I have posted before, then re-read what you just wrote, and see if what you wrote makes sense relative to what I wrote, or if it reflects an understanding on your part as to what I wrote. Do you think you can do that? Oh, forget it. You must have taken a while to read through what I posted, yet mananged to get it wrong. Better yet, have someone read it to you. Seeing that you pride yourself on your honesty, I refuse to believe that you would deliberately distort my words to score cheap points. So it has to be your comprehension skills, or the lack thereof.

Let's try this again. My argument is simple. The &quot;buggery&quot; law is unconstitutional because it violates a citizen's right to freedom of association as guaranteed by the Jamaican Constitution, which states: &quot;<span style="font-style: italic"><span style="font-weight: bold">No person shall be hindered in the enjoyment of his freedom of peaceful assembly and <span style="text-decoration: underline">association</span>, that is to say, his right peacefully to assemble freely and <span style="text-decoration: underline">associate with other persons </span>and in particular to form or belong to trade unions or other associations for the protection of his interests</span></span>.&quot; [Section 23 (1) Jamaica Constitution]. The Constitution is the supreme legal framework within which all laws are made. If a law violates a constitutional right, it is unconstitutional, simple as that. Even duly created acts of parliament, believe it or not, can be unconstitutional.

Now you may ask: if the law in question is unconstitutional, then how is it still on the books? Two reasons: (1) Politicians over the years have been literally afraid to do anything about that law. I chuckled when I saw the PNP issuing a statement reprimanding Earnest Smith when they did nothing to overturn the law in question. Granted, it enjoys popular support, but even in enlightened societies, including democracies, popular sentiment is not sufficient as a basis for enacting or upholding laws. In Jamaica, taking an intelligent viewpoint on the issue will call into question one's sexual orientation.

(2) Jamaica has an independent judiciary, yet, like most judiaries in parliamentary democracies, it seems to have difficulty striking down laws/acts of parliament, choosing instead to defer to the legislative branch. It doesn't usually assert it powers of judicial review - which is to determine the constutionality of laws/acts of parliament. Despite the fact that the American system of government is different and comparisons are not always appropriate, one thing that both the Anglo and the American system have in common is independence, which carries with it the power of judicial review. And the American judiciary has used this power a number of times to invalidate state and federal statutes as well as executive orders. In Jamaica, the judiciary almost refuses to do so. But they may become more assertive in future, as some organization which can show standing challenges that law in the courts. BTW, it is recognition that such laws violate the right of freedom of association why other countries with parliamentary democracies abolished the law - the UK, Canada, Australia, New Zealand, etc.

The refusal of an independent judiciary to assert its rightful powers (including judicial review) is troubling on a many levels, notably among which is this: parliament is about politics and the sways of popular sentitments and opinion. The judiciary ought to rise above that and to be the true guardian of the constitution. That's why there is a judiciary.

Jamaicans seem to be indifferent to a lot of things that is bad about Jamaica,except when it comes to homosexuality,so much time and energy is spent on this one issue at the expense of all the others that really matter.
