Tenk yu Humano.... succicent and the point I was making badly. With the poltical drivers concerning enviroment this concept will become more important...as to what you can and cant do on your land.... Eminent domain..

(I know of a case where there was some 40 acres of original forest and the goveremnt threatehrn to take the land through eminent domain if it was not developed so the owner cut down the trees and found that it was pure rock stone!)

The term crown is misleading... it merely means the Jamaica... Not the Queen. this is to diferntiate between the poltical rulers of Jamaica (JLP), and Jamaica.. The oppostion has loyality to to the Crown.. not to the poltical party in power.. Change the term Crown to state.. it signifies the same thing. Ig you say people of Jamaica instead of crown it weakens the right for an oppostion party to tell the goverement that they are talkin crap... the state becomes wrapped up in the poltical party in power.. state vs goverment....

i beleive it comes in if you have land that has not been captured / and has been used for a specific use for 7 years.... ie if you have squatters but dont kick them out or dont tell em to leave or if athee has been a road through your property and you dont stop em using it..... However if the legal owner has been paying the taxes there is a case against losing the title.. what would i know I am no tort/ commerical lawyer ????

In the US, the notion of <span style="font-style: italic">eminent domain</span> may also extend to private developers who can offer a compelling case as to why the land they seek (usually being owned by a small land owner) will be used to serve some greater public good. There have been a number of cases at the municipal level where certain big developers sought to 'take' certain areas for housing and retail spaces, arguing that those properties would yield greater revenues for the city and county coffers. I even know of a case where a man living on his land for over 20 years with a modest looking house was pressured to sell his property to a developer who was building a sub-division encircling the man's land, and thought the man's house was too ugly and was a 'sore eye' against his spanking new project.

I can kind of understand when it's for a road or highway or something like that, although I doubt I'd be willing to understand if it was my property being taken. But for more casinos, a shopping strip, something like that I'd really be [censored]. </span>

In aberdeenshire there is two cases.. Trump is in town trying to build a golf based resort up the road from me at Balmedie.. He has planning permission but there is one guy who owns a bit of land that he wont sell for a million pounds...So far the cumplusory purchase has not happened... It is an god awful area to be honest.. golf courses would be an improvement...


There is more important Aberdeen by pass a much needed road.. this was talked about for the last 50 years but nothing it will cut through a number of properties and it is being fought tooth and nail.... That will happen because it is needed... Friend of mine fought a cumplusory purchase and won.. his tactic was get a lawyer.. he sent a letter to the council recorded delivery telling them t ocommunicate directly with his lawyer.. they kep sending him letters... he ignored them.. he refused to move.. he was taken to court and he simply produced the letter and record of the letter being sent.. and the whole process had to be restarted..

the primary reason why we need independent courts..
