Agreed. If I am not mistaken, there is/was something called "goodwill" where some legal agreement is drawn up and both parties sign. This was to curtail the "capture land" practice that was prevalent then and even NOW..but as Doc inferred, in the final analysis, the land still belongs to the owner, and whatever is there is on it.
