It's a last resort.

That's how Chicago's Mount Sinai Hospital describes its practice of sending undocumented immigrants back to their country of origin.

Cara Pacione, director of social services, spoke to me about the hospital's experience as I was preparing a story for Wednesday's paper.

The New York Times wrote an extensive piece about the controversial practice two weeks ago, thrusting it into the national spotlight.

The Tribune also examined the topic in articles about a stroke survivor sent to the Philippines by a Des Plaines nursing home because he was uninsured. Orlando Lopez, an undocumented Filipino alien, was afraid he'd die after the Nov. 2005 transfer – and he did.

Pacione says that hasn't happened to Mount Sinai former patients. Over the last six years, the hospital has returned people in the U.S. illegally to Mexico, Poland, Lithuania, Honduras and Guatemala after serious illnesses and accidents. For the most part, the transfers worked out "relatively well," she says.

<span style="font-weight: bold">All were moved with their own consent or that of their families, and in each case Chicago doctors talked to colleagues in the patient's country of origin "to make sure they would offer an appropriate level of care," Pacione explains.</span>

That's not good enough, some advocates argue. Once a patient returns to a country such as Mexico, a hospital that initially accepts him can later transfer him to another, sub-standard facility and he'll have no recourse, said Sonal Ambergaokar, health policy attorney for the National Immigration Law Center.

It's one thing for a patient to give medical consent to a transfer; it's another thing to waive rights to challenge what is in effect a deportation, Ambergaokar argues. She's willing to believe hospitals do the former and doubts they do the latter.

The hard reality is there are no good choices for undocumented immigrants who need long-term medical services.

Staying in a hospital for months or even years can be dangerous; these institutions are breeding grounds for infection and aren't designed for chronic care. Finding another facility willing to take someone without insurance is nearly impossible. (Illinois doesn't pay for nursing home care for illegal immigrants.)

If a patient is in relatively good condition, arrangements can often be made to help them be cared for at home, relying on family members and community supports, Pacione says. Mount Sinai will help by providing home health services and physical and occupational therapy free of charge.

But if an immigrant patient is bad off, requiring extensive nursing care, their family typically won't be able to shoulder the expense of in-home care. That's when the hospital has to start looking for other alternatives, including sending the person back where they came from, Pacione says.

Pacione tells of a Lithuanian man in his 40s who ended up staying at the hospital 13 months after a traumatic brain injury. Eventually, hospital officials located his mother in Lithuania and arranged for him to return to that country, first to spend several months in a rehabilitation facility and then with his mother at home.

The Lithuanian consulate helped prepare the necessary documents and a Mount Sinai physician and physical therapist escorted the patient on the flight abroad.

The University of Illinois Medical Center at Chicago, embroiled in a current controversy over a Mexican man in a coma, also has had experience with the practice. In the past two years, the hospital has returned two patients to Poland and one to Mexico, said Dr. William Chamberlin, chief medical officer.

In one case, it flew a patient's wife to Chicago so she could accompany him on the return flight to Mexico, he said.

Legally, U.S. hospitals are responsible for treating all patients in medical emergencies and finding a setting with adequate services to send them to once they've been stabilized. The intent of existing laws is to prevent indigent patients from being dumped on the street or at home.

In years past, Cook County agreed to support some of these patients for years in the long-term care unit at Oak Forest Hospital. But most of the unit's beds have been closed and Cook County has indicated it will not pay for long-term services for new undocumented immigrants going forward.

Do you think hospitals have an obligation to keep treating these patients in the U.S. rather than shipping them off to the countries they left behind? What about these countries' obligations? Should they assume responsibility for people who are still, legally, their citizens?

In his most recent (August 22, 2009) weekly radio address, President Obama railed about the supposed "outrageous myths" surrounding his plan for Health Insurance reconstruction, a plan that is often shilled as Health Care Reform.

One of the things he attempted to refute was the concern tnat illegal immigrants would be covered under ObamaCare.

From Reuters (Washington, DC):

Today, I want to spend a few minutes debunking some of the more outrageous myths circulating on the Internet, on cable TV, and repeated at some town halls across this country. Let's start with the false claim that illegal immigrants will get health insurance under reform. That's not true. That idea has never even been on the table.

In a Rovian sense, what President Obama asserted is true, or at least not completely false. Title II, Subtitle C, Section 246 of the bill (HR 3200) - dealing solely with insurance subsidies - states:

SEC. 246. NO FEDERAL PAYMENT FOR UNDOCUMENTED ALIENS.
Nothing in this subtitle shall allow Federal payments for affordability credits on behalf of individuals who are not lawfully present in the United States.

That is very clear and concise verbiage. Under the provisions of HR 3200, illegal immigrants would not be allowed to receive federal subsidies with which to acquire health insurance from the proposed Health Insurance Exchange.

<span style="font-weight: bold">But illegal immigrants are allowed - as anyone should be, regardless of residency status - emergency medical care under Medicaid, and HR 3200 not only expands Medicaid eligibility but also restricts (via Section 1702) inquiries about immigration and residency status.</span> This would make it difficult for state agencies to prevent illegal immigrants from receiving fully subsidized medical care above and beyond what they are currently entitled to receive.

So technically, President Obama is telling the truth in that illegal immigrants will not be eligible to receive federal subsidies for the purpose of acquiring health insurance from the proposed Health Insurance Exchange. He is, however, being extremely disingenuous in his statement, hence the above reference to Karl Rove, since HR 3200, America's Affordable Health Choices Act of 2009 (AAHCA), would grant illegal immigrants greatly expanded access to medical care. Indeed, the provisions in Section 1702 of the bill could allow them access to 100% taxpayer subsidized non-emergency medical care.

So is the claim that ObamaCare will cover illegal immigrants an "outrageous myth?" No, but it is an oversimplification of the matter. This is very much the same as President Obama's "outrageous myth" that ObamaCare won't cover illegal immigrants.

<span style="font-weight: bold">Florida Deportation Case Further Fuels Debate Surrounding Health Care for Illegal Immigrants</span>

In late July, <span style="font-weight: bold">a six-member jury in Stuart, Florida, decided that a South Florida hospital was not legally liable for damages for chartering a plane and deporting a brain-injured Guatemalan patient who was in the United States illegally</span>. Legal and healthcare commentators nationwide have closely watched the civil matter unfolding and note it underscores the dilemma facing hospitals who encounter uninsured, illegal immigrant patients seeking long-term care.

<span style="text-decoration: underline">Background</span>

In 2000, Luis Jimenez was in the United States illegally, working as a day laborer in Florida and sending money home to his family in Guatemala. That year, a drunk driver crashed into a car he was riding in, leaving him a paraplegic with the cognitive ability of a fourth grader, and killing two passengers.

Under the Emergency Medical Treatment and Active Labor Act (EMTALA), Martin Memorial Medical Center was required to provide emergency care to Jimenez, and provide an acceptable discharge plan once he was stabilized. Because he was in the country illegally, Jimenez was ineligible for Medicaid, aside from a nominal amount allocated for emergency cases. The hospital treated Jimenez at its own expense and eventually transferred him to a Florida nursing home in 2001. After spending a few months in the facility, Jimenez was transferred back to the hospital’s emergency room to be treated for severe bedsores. Martin Memorial rehabilitated Jimenez once more and again sought to transfer him to another long-term care facility. However, due to Jimenez’s immigration status and lack of insurance, no facility in the United States was willing to provide him with long-term care. Because of his incapacitation, Jimenez’s cousin, Montejo Gaspar, was named as his legal guardian and worked toward securing long-term care in Guatemala; however, Gaspar had difficulty finding a suitable facility there as well.

Jimenez spent nearly three years at Martin Memorial before the facility, backed by a letter from an official with the Guatemalan government, persuaded a Florida district court judge to sign off on a transfer of Jimenez to a healthcare facility in Guatemala. Gaspar, as Jimenez’s legal guardian, appealed the judge’s order but before a final resolution was made, the hospital put Jimenez on a $30,000 charter flight home in 2003, without informing Jimenez’s family. Gaspar eventually won his appeal, but by then it was too late. Jimenez had been shuffled between various Guatemalan hospitals and was eventually released. He is currently living with his 73-year-old mother in a one-room home in a remote Mayan village.

A Florida appeals court overturned the district judge’s decision allowing Jimenez to be flown out of the country, holding there was a lack of jurisdiction to make such a determination. Gaspar then sued the hospital seeking nearly $1 million to cover the estimated long-term healthcare costs of Jimenez’s care in Guatemala and damages for what he believed to be the hospital’s kidnapping and false imprisonment of his extremely disabled cousin. In late July, a jury in the civil damages case decided that Martin Memorial was not liable for false imprisonment of Jimenez and, thus, not liable for damages.

<span style="text-decoration: underline">Illegal Immigrants and the Health Care Costs</span>

In 2008, the number of illegal immigrants in the United States was estimated to be between 11.6 and 11.9 million, down from an estimated 12.7 million a year earlier. Of those, the illegal immigrant population is reported to be made up mostly of young families with children living in poverty and without health insurance. Though many experts note that the illegal immigrant population in the United States has leveled off in recent years, the number of children born to undocumented individuals rose from 2.7 million in 2003 to nearly 4 million in 2008.16 Those children are entitled to citizenship, and thus entitled access to some form of government-sponsored health care. However, the parents of those children are not.

States annually spend millions on health care for illegal immigrants – with those bordering Mexico shelling out the most. A study by the United States/Mexico Border Counties Coalition found that hospitals along the border spent nearly $200 million on emergency health care alone to undocumented immigrants in 2000.17 Total healthcare costs spent on illegal immigrants total in the multi-millions or even billions annually.

In California, a state struggling to fiscally survive, some counties are cutting health services to illegal immigrants. In Sacramento County, two health clinics serving the poor and undocumented closed in February, saving millions in a $55 million general fund shortfall.19 In Contra Costa County, a plan has been proposed to screen out illegal immigrants – except for children and pregnant women – from nonemergency healthcare services that are provided to low-income residents unable to get insurance.

<span style="text-decoration: underline">Health Care for Illegal Immigrants in Texas</span>

Hard data and accurate statistics regarding healthcare services provided to illegal immigrants in Texas remains elusive. However, according to a report by the Texas Health and Human Services Commission, the State spends approximately $678 million annually on their health care. The study estimated that $597 million was spent by 94 public hospitals in the state during fiscal year 2005-2006 and the remainder, about $81 million, went to the state’s contribution to emergency Medicaid which pays for emergency medical care, including childbirth.

Some Texas hospital districts record amounts spent on “uncompensated” care, but often fail to specifically account for the money spent on illegal immigrant care. For example, the Harris County Hospital District, serving Houston and surrounding areas, spent nearly $203.5 million in uncompensated care. Parkland Hospital spent $478 million on uncompensated care in 2006 and $512 million in 2007. Additionally, poor statistics fail to provide a true picture of the immigrant population in Texas. In the 2000 Census, the U.S. Census Department estimated that the overall percentage of illegal immigrants in the United States who live in the state to be around 17 U.S./Mexico Border Counties Coalition, Medical Emergency: Costs of Uncompensated Care in Southwest Border Counties, (Sept.2002) (The study found that California spent $79 million; Texas spent $74 million; Arizona spent $31 million; and New Mexico spent $6 million) That results in an estimated 1.7 to 1.9 million illegal immigrants living in Texas.

These estimated immigrant population numbers and healthcare costs are precisely that – estimates. True figures and amounts will continue to be elusive as long as state agencies fail to collect the hard data. That may be a risky plan with national lawmakers mulling over health care reform proposals, including one that would extend Medicaid to nearly 1 million Texas adults – a massive jump from the approximate 38,000 who currently qualify.

<span style="text-decoration: underline">Conclusion</span>

Presently, Martin Memorial Medical Center in Florida is treating another illegal immigrant from Mexico with severe brain damage. The facility has spent nearly $1.5 million over the last two years on his care and has contacted the United States and Mexican governments for assistance in returning the man to Mexico, without any response.

<span style="font-weight: bold">Recently, President Obama was asked whether illegal immigrants should be covered under a new health care plan. His response was “no” with a possible exception to be made for children.</span> Unless some reforms are made to the current healthcare system specifically addressing illegal immigrants, including Medicare and Medicaid, it is likely that states and private providers will continue to spend millions on their care.
