Sir'Mone McCaulla Found Dead

Sources tell Fox 5 News that the man the NYPD believes stabbed a tourist in Midtown Manhattan has killed himself.

Sir'mone McCaulla, 28, electrocuted himself on Tuesday, according to sources. The former Army soldier was reportedly found inside a bathtub hugging a cable box and wearing a bag over his head.

Police in Philadelphia and NYPD detectives were at the home of McCaulla's girlfriend on the west side of the city early Wednesday morning.

McCaulla allegedly stabbed Christopher Guiterrez, 20, on Sunday after bumping into him outside the James A. Farley Post Office. Guiterrez died. His funeral is expected to take place later this week.

A drunk NYPD officer struck and killed a Brooklyn woman early this morning - and his three passengers, including at least one other cop, fled the deadly scene and left her dying in the street, police sources and witnesses said.

Driver Andrew Kelly, 30, who is assigned to the 68th Precinct in Bay Ridge and lives in Flushing, Queens, was arrested after mowing down Vionique Valnord, 33 at the corner of Avenue N and 56th Street, cops said.

Sources said he refused to take a breathalyzer test and investigators obtained a warrant to draw his blood.

A second off-duty cop in the front passenger seat and two more in the rear bolted immediately following the deadly collision, sources said.

Kelly was driving westbound on Avenue N when he struck Valnord, Police Commissioner Ray Kelly told reporters.

The commissioner said the officer in the passenger seat reported to his regular precinct hours later and told his superiors that he was in the car.

"He's being questioned about the circumstances of the accident," said the commissioner.

It was unclear whether the other two officers had been identified.

Leaving the scene of an accident is a crime only for the driver of a car. Passengers are not required by law to stay behind, but the three other officers might still face departmental discipline for fleeing.

"I have never heard of it applying to anyone else but the driver," said defense lawyer Steven Chaikin.

Officer Kelly was taken from the scene wearing what appeared to be civilian clothes - a Yankees jacket and cap, work boots and cargo pants. He was charged with vehicular manslaughter and driving while intoxicated.

Commissioner Kelly said cops responding to the scene of the accident smelled alcohol on Officer Kelly's breath.

Valnord's father, pastor of the Church of God on Rogers Avenue in Crown Heights, gathered the strength to deliver his customary Sunday sermon, despite the unimaginable tragedy.

"When it's time for God to take you, you must go," he told congregants. "God decides whether you live or die."

Friends said Vionique Valnord was leaving the wedding of two church members and trying to flag down a cab when Kelly's Jeep slammed into her at about 45 miles per hour.

"I saw her body in the air, flipping and twisting, and I heard it hit the ground," said Richard Augustin, who also attended the wedding.

Witnesses said several people - including the driver - rushed to Valnord to try to resucitate her.

"She was breathing slowly," said another witness, Ricardo Brisard, 22. "She was hit on the right side. Her right leg was broken. She was still alive."

Valnord died of her injuries at Kings County Hospital.

While many friends in the close-knit church community tried to remember that God hates the sin - not the sinner - others were less kind.

"He should go to jail, if he's a cop driving drunk," fumed a 28-year-old parioshioner who declined to identify herself. "This needs to be pursued. They need to put some pressure on [the other cops]."

Kelly's neighbor, Felix Aponte, was stunned by the news.

"He's a great guy," Aponte said. "Always willing to help you. I'm stunned by this. It doesn't sound like him."

It took authorities more than seven hours to draw blood from an accused drunken cop who killed a preacher's daughter while driving back to a bar for more booze, the Daily News has learned.

The time lag - partly because a doctor wrongly thought Brooklyn Police Officer Andrew Kelly's consent was necessary - could make a dramatic difference in prosecutors' ability to convict the officer.

The seven-year NYPD vet is charged with manslaughter and DWI in the death of Vionique Valnord, 32, as she hailed a cab in Old Mill Basin, Brooklyn, at 12:41 a.m. Sunday.

Kelly and one of his three passengers, Officer Michael Downs, worked overtime at the Yankees-Red Sox game at Yankee Stadium on Saturday afternoon in the Bronx and then drove back to Brooklyn.

Kelly told cops he went to one bar, where he drank an unspecified amount.

He then went to another, where he downed six to eight beers, police and other sources said. Sources said one of the bars was the Third & Seventh in Marine Park, where last night plainclothes officers were seen examining security footage.

Kelly refused to take a Breathalyzer test and, while reeking of booze and slurring his speech, told responding officers there was no way they were going to draw his blood.

"I'm not going to let that happen," he said, one source briefed on the incident said. "You're going to have to tie me down."

Kelly's obstinance, the source said, caused the first delay, and the Brooklyn district attorney's office was not notified until 1:54a.m.

The next three hours went as planned, the source said, with investigators doing the required interviews. Brooklyn Criminal Court Judge Joseph Gubbay granted the warrant about 5:30a.m., after prosecutors called him at home, the Office of Court Administration said.

When Kelly, 30, arrived at Kings County Hospital at 5:52a.m., he refused to consent to give blood. A doctor there mistakenly believed consent was necessary and would not draw blood, two sources said.

After a flurry of phone calls involving Internal Affairs and prosecutors, Kelly's blood was taken about 8 a.m. - seven hours and 20 minutes after the accident.

Test results have not been released.

Pardon me ma'am, I had not read the memo that said <span style="font-weight: bold">Sharpton is Head of Injustice</span> and should stop his personal life and provide service everytime someone is run over.

I've marched with Sharpton for many years, and have been an activist myself for many years across all boroughs, and I simply asked a question based on what I've heard from many who always accused him of interfering. Yet when it is convenient this man should stop his life and get involved.

I find that line of thinking presumptuous and unreasonable.
