A high court judge in Roseau has awarded over half a million dollars to a former Miss Dominica contestant for defamation in a case involving a photo of her face, which was added to a digitally altered pornographic image and circulated over the World Wide Web by her coworkers.


The former Miss Dominica contestant, Blossom Marina Marshall, was at the time employed at the Dominica Electricity Services Ltd. (DOMLEC). The defendants were Lenisha Augustine and Cressida Raymond, who were Marshall's co-employees at DOMLEC, and Georgette George and Ann Marie James, who were employees of Worldwide Wagering, an internet gaming company doing business in Dominica at the time.

The court documents revealed that sometime on November 18, 2000, Georgette George published an email entitled “sallop (open and be surprised) what you always wanted.” ( Sallop is a creole word generally used to refer to a whore). Attached to the email was the body of a woman in a sexually explicit pose, engaging in sexual activity combined with the face of Marshall.

George subsequently forwarded the email to eight persons including James, who then forwarded it to several persons including Augustine. Consequently, Augustine emailed it to Raymond who emailed it to several other persons.

<span style="text-decoration: underline">When the e-mail became public, Marshall was forced to drop out of the Miss Dominica pageant and was subsequently fired by DOMLEC where management believed that she was the person depicted in the photos.</span>

Marshall also lost several modeling contracts, found it difficult to find a new job, and was constantly harassed by the public causing her to withdraw and staying away from being seen in public.

In his findings, acting High Court Judge Anthony Ross QC ordered Augustine, George and James to pay Marshall $525,000.

He cited $225,000 for general damages, $180,000 for aggravated damages, and $120,000 for exemplary damages.

The judge also expressed disappointment that DOMLEC was not a defendant to the proceedings citing the issue of unjust dismissal. He also expressed surprise that no investigation was carried out by the police.

As for Marshall, she is said to be still suffering from the effects of the e-mail although she is currently employed as a flight attendant with LIAT. She was represented in court by local attorney, Lennox Lawrence.

That was kind of easy to trace.
Since it was an Email and such a small number of recipients.

The problem is how much will she see out of it?
Her lawyer might have been cowed into not adjoining the electric company.

i saw a clip of some j'can yutes mek sex tape &amp; it end up pon internet...

girl's face clear as day cleaning my yute rifle...

makes me wonder if they knew it would be posted on the net...

jamaica now definitely not the same jamaica i came from...
i can't imagine my generation doing this even if the technology had been available- just out of the fear of the possibility of the video getting out, much less girl showing her face big &amp; bold in the video;
