While serving, the plane hit a bit of turbulence.
Di service cart roll ahn crash into your foot and brake your toe.

Who is at fault?

god. its all his fault. he created the turbulence hence causing the airplane to erratically shake (is the said plane a Airbus A-320?)

which in turn allowed the serving cart to become dislodged from the stewardesses grasp in turn rolling over the said indidual foot.

so, in my humble legal opinion; I would probably name on my lawsuit:

Airbus
Airline
Stewardess
Pilot

HO is probably on the right track.

Dem might give the person a smalls for the trouble, but turbulance is an act of god, or act of nature.

When there are weather delays, dem wi gi yuh a meal fi yuh chubbles, but no other compensation cause a nuh fi dem fault. Maybe same applies to the above senario.

well MAYBE the traveller should have purchase travel insurance just in case.like maybe BLUE CROSS?

or maybe the individulal shouldnt have been sticking his foot into the isle and keep it in front of the seat position- what if someone tripped over his foot and broke his neck? who gonna pay for his funeral?

my recommendation to the Airline seeing as they retained me to defend this unscrupulous case..
I would probably offer a minute settlement like maybe a free travel pass for your next flight AND MAYBE a thousand bux for incidentals like a toe cast and a taxi ride to the emerg.

not dem <span style="font-style: italic">fault</span> but IS dem <span style="font-style: italic">responsibility.</span>

the airline is responsible for the safety of it's passengers; if the injury occurred on their plane on their watch, they are responsible for taking care of their customer even if it's not their 'fault'.

don't know if that would hold up 'legally', but that's the direction i'd be going in with them.

if they're a decent company with decent people, they would take care of all medical care &amp; bills, just out of decency and concern for their customer - a thousand bucks should cover alla that!

but if they nasty greedy sonsa*****es them will abdicate responsibility and stick you with de 'not our fault' mumbo jumbo.

i once got a national moving company to 'do the right thing' just by writing a serious letter to their CEO. no need to involve no legal nobody - he had the company cut me the check....

mi ask weh dem foot was when di cart crash. dem seh it was in front of the seat. di smaddy said the cart was at an angle after the turbulence ahn one male flight attendant had to unwedge it from the seat and dem foot. dem call di ambulance from the air and it was waiting when dem land.

the airline ...they r suppose to make concessions for such an event...the carts r to be put on them brakes..sortof like how hospitals put di brakes of u wheelchair an bed wen dem stop push ....

if dem dont have brakes , well dem should n ur lawsuit might mek dem get dem

eida way, they can be held liable for medical expenses at the very least

afta all u neva know wen turbulence mite occur...an usually the cockpit alerts as to it coming up...at that point dem really suppose to secure it in wicheva way will mek it no roll pon nobody

i would think the airline is at fault since it can expected that during flight you might encounter turbulence and they have a duty to exercise reasonable care to ensure that passengers are not injured.

a letter from a lawyer should suffice to have all expenses covered.
