Guard Claims He Saw Kilpatrick Touch His Wife's Breast

DETROIT -- Former Detroit Mayor Kwame Kilpatrick has been cited on suspicion of sexual misconduct during a meeting with his wife in the inmate area inside the Oaks Correctional Facility in Manistee, Mich.
According to an incident report, a guard saw Kilpatrick touch his female visitor's left breast with his right hand during a July 4 visit.
"I observed this via the visiting room camera," the guard wrote on the report.

The warden identified the visitor as Kilpatrick's wife, Carlita.
"I talked to the warden this morning she reviewed the videotape and it was apparent that he did this and it almost looked as if he was watching the officer in the visiting room to see when there was a good time to do this," Michigan Department of Corrections Officer Russ Marlan.

According to prison rules, inmates are only allowed one kiss and one hug at the beginning and end of the visit and when posing for photographs.
They are also allowed to hold hands with the visitor during the entire meeting. However, no further contact is allowed.
"The visiting room, there are other prisoners in there visiting their families and there are children in there," said Marlan. "We've been doing this a long time. We see issues with things being passed in the visiting room or sexual assault occurring in the visiting room, so we set these rules for a reason."
If Kilpatrick is found guilty of sexual misconduct, the parole board would be notified and it would be taken into consideration when he has a parole hearing, according Marlan.
“This is the most ridiculous thing I’ve ever heard of in my life. Another example of people trying to pile on in any way, shape or form on this man. This is his wife. Not his girlfriend, not a guard, not somebody he met at the prison," said Kilpatrick's representative Mike Paul.
In May, Kilpatrick was sentenced to 14 months to five years in prison for probation violation in two 2008 criminal cases stemming from lies Kilpatrick told under oath during a 2007 whistleblowers' lawsuit trial.
Kilpatrick will now have to go before an administrative law examiner, who would then determine whether there was a violation.
However, that will not happen until Kilpatrick returns from federal custody.
"The charges are still pending at this point, but he was issued a misconduct," said Marlan.
"If the alleged incident did indeed happen, Kilpatrick should have been warned, like any other prisoner on a first time offense, and not written up," said Paul. Someone in the prison is obviously looking to make a name for himself by going after Mr. Kilpatrick once again. This time for allegedly loving his wife. This is absurd."
Marlan denied Paul's claim that it was a rogue guard who was trying to prove himself.
"It's not an officer trying to make a name for himself, just trying to enforce the rules that we have in our visiting room," said Marlan.
On Tuesday, he was arraigned in a federal courthouse on 19 counts of felony fraud and tax charges.

The federal charges stem from the misuse of a nonprofit fund, and are unrelated to the text message scandal that forced him to step down as mayor in 2008.
He served 99 days in county jail and was ordered to repay Detroit $1 million in restitution. He wound up behind bars again after Wayne County Judge David Groner determined he failed to adequately report his assets and turn over certain financial records.
