I am helping someone create an ad to run in a local newspaper (this is a favour - I'm not charging).
She is branching out into her own business and she wants to lift and use a picture of herself that is posted on her former employers website to use in the ad. She is now going to be in direct competition with her old employer and because they live in the same community I'm sure the old employer will see the ad and notice that she got the picture from his site. The old employer did hire an amature photographer to take the picture in the first place.
I am hearing different things. Some people say that because the picture is not copyrighted (which I'm pretty sure it's not) then it is open to be used by all
but I'm not sure.
