Legal Help Needed

I am helping someone create an ad to run in a local newspaper (this is a favour - I'm not charging).

She is branching out into her own business and she wants to lift and use a picture of herself that is posted on her former employers website to use in the ad. She is now going to be in direct competition with her old employer and because they live in the same community I'm sure the old employer will see the ad and notice that she got the picture from his site. The old employer did hire an amature photographer to take the picture in the first place.

I am hearing different things. Some people say that because the picture is not copyrighted (which I'm pretty sure it's not) then it is open to be used by all
but I'm not sure.

???

Note:
She left her former employer in a bitter fight so he is not happy with her in the least.


Anyone out there know anything about the legalities of the internet?

it's her picture - after you lift it - she needs to write him and have him take it down for using it without her permission - then use it

Unless shi gets di former employer's permission, dem technically own di photograph. She automatically gave her permission for them to use her image, being a former contractual employee of her former company. They also paid for it.

Whi don't she just have a ney one made?

No different than a actor, or model who does a shoot, or commercial. The company now owns that commercial and its images.

wha mek she cant get another picture taken and use
by rights she gave permission to have her picture use in the former boss paper and she never seem to did have any problem wid it so it belong to dem

She needs the ad to run this weekend and the deadline for submitting the ad is today. No time to get a new picture done that will be suitable.
