with murder when the grand jury declined to indict when the chokehold happened

BRIDGEWATER — A 19-year-old former high school football player in New Jersey has died more than eight months after authorities said <span style="font-weight: bold">he was put into a chokehold while trying to break into a car.</span>

Douglas Uhler's father wants charges filed against the car's owner, 42-year-old Alex Montalvo of Bridgewater.

Somerset County prosecutors told The Star-Ledger of Newark <span style="font-weight: bold">Montalvo awoke and gave chase after finding his car being broken into on July 31.</span>

Prosecutors say after Montalvo knocked out Brian Johnston,<span style="font-weight: bold"> Uhler ran out from bushes and shouted: &quot;You want a piece of me, (expletive)?!&quot;</span>

Prosecutors say Uhler jumped on Montalvo, who put him in a submission hold, blocking the teen's oxygen flow and causing a brain injury.

Johnson pleaded guilty to third-degree burglary charges.

If anyone should be charged with manslaughter murder, I would think it would be Johnston. After all, someone died while he, and Uhler was committing a crime. Uhler died as a direct result of their immediate, and subsequent actions. He obviously thought, because he played football, he could take Montalvo. He found out he was wrong.

Second, I think Johnston has enough going on with the crime he actually was trying to commit Jkid, Short of him having shackled Uhler to him and dragged him along to steal the car, I do not see how he is in any way responsible for his death.

As i was typing, I realized you were asking about Uhler's father Kia. Well, I don't really expect him to be rational about the thing; his son is dead. Did Montalvo break any laws? Like I know that if someone is breaking in, I have to wait for them to actually get in before I blow their back out.

If I caught someone prowling around my place, chances are they'd be looking down the end of a loaded 12 gauge barrel. Don't do the crime if you can't do the penalty.

Yes Tulip it was Uhlers parents that wanted Montalvo charged. Montalvo did commit a crime but the grand jury (made up of our peers ) declined to indict!

and as the 12 gauge barrel was legally owned you would probably be cleared! Uhler got what was coming to him especially after his statement , 'you want a piece of me &lt;expletive&gt;' - he just did not know he would buck up a choke hold

If I am not mistaken, the law stipulates dat if some is killed while committing a crime, the co-conspirator present is also responsible?

also those who know and use defensive moves that can kill will be charged if said is used to kill...
