T he execution of Troy Davis says some things about our legal system which apply to lots of issues beyond the debate over the death penalty. I had some (very tangential) involvement in this matter, so I think I know the case file well enough to say the following with confidence: Davis’s execution was a grotesque travesty of justice, but it also resulted in the legally correct outcome, if by “legally correct outcome” one means what law professors usually mean when they ask if a case was “correctly decided.”

In brief, Davis’s problem was that, if he wasn’t able to demonstrate, after his conviction, that he had not gotten a full and fair trial — and he wasn’t able to demonstrate this, because the trial he got pretty clearly met the standard of what counts as a “fair trial” in our criminal justice system, at least for the purposes of the existing state and federal laws — then the only way he could avoid execution was to convince the authorities reviewing his case that he was actually innocent. (The inimitable Justice Scalia went so far as to declare that even this wouldn’t be good enough for the purposes of a federal court review of his case, because “this Court has never held that the Constitution forbids the execution of a convicted defendant who has had a full and fair trial but is later able to convince a habeas court that he is ‘actually’ innocent.”).

Davis’s execution was a travesty of justice because, in my opinion, the chances are a good deal better than even that he didn’t murder Mark MacPhail. It’s more likely, in my view, that Redd Coles — the key witness in the case against Davis, and the man who went to the police in the first instance with the claim that Davis killed MacPhail — is MacPhail’s actual killer.

In retrospect the claim that Davis was guilty beyond a reasonable doubt for the crime for which he was executed is completely indefensible, but again, as a procedural matter, once Davis was convicted for the crime in what counts in our system as a fair trial (and he was), then as both a formal and practical matter Davis had to prove his innocence to a fairly high degree of certainty in order to avoid execution. This he was unable to do (I certainly don’t claim to know whether Davis was in fact innocent — I personally think the available evidence suggests he was, but that’s quite different from that evidence amounting to a genuine exoneration). So, as a formal legal matter, Davis’s execution did not involve any violation of state or federal law, even though he was probably innocent.

Now this realization should fill any decent human being with a sense of disgust, but it affects certain legal actors with something more like exasperation at the extent to which our current system refuses to achieve “finality” within a reasonable time frame. Justice Scalia’s dissent linked above could not be more clear on this point: what matters to him is whether or not the rules have been followed, and if they have then the execution of a probably innocent man is just one of those prices “we” must pay for all the wonderful things we get from the legal system.

As I have argued elsewhere, Scalia represents an extreme example of a certain kind of judge that positively revels in coming to conclusions that are morally revolting but “legally” sound. Judges of this type like these sorts of cases because they demonstrate that law is a supposedly nonpolitical and intellectually rigorous practice, rather than a touchy-feely exercise in doing what strikes the judge as the right thing.

What, after all, could be more nonpolitical and intellectually rigorous than executing an innocent man, simply because “the law” requires that result? In a perverse way, such bloody logic is a kind of advertisement for the supposed objectivity of the legal system, since we can assume that no sane decision maker would reach such a decision voluntarily. (The great legal historian Douglas Hay explained the 18th-century English practice of sometimes acquitting obviously guilty men on absurd procedural technicalities, such as incorrectly calling the defendant a “farmer” instead of a “yeoman,” in similar terms: “When the ruling class acquitted men on such technicalities they helped embody a belief in the disembodied justice of the law in the minds of all who watched. In short the law’s absurd formalism was part of its strength as ideology.”)

This insight applies to many more aspects of the legal system than the revolting spectacle of our contemporary system of capital punishment, which in a case such as Davis’s — which is not in this respect was not unusual — psychologically tortures the defendant, the defendant’s family, the victim’s family, and others connected to the case for literally decades before producing what the system then has the temerity to call “justice.” (The climax of this spectacle last night involved Davis being strapped to a gurney with a needle in his arm for nearly four hours, waiting for various legal personages to respond to the question of whether, all things considered, it was finally time to stop his heart with state-administered poison).

That we tolerate this kind of thing so readily helps explain, in its own way, why it sometimes seems impossible to do much of anything about the absurdities and dysfunctions of the system of legal education that legitimates it in the first instance. Or perhaps it’s the other way around: perhaps we tolerate the absurdity of something like the 22-year “process” that resulted in the horror of Davis’s final hours because we ‘re socialized from the beginning of our careers in this system to accept all kinds of absurdity and injustice as natural, inevitable, and therefore legitimate.

Former President Bill Clinton weighed in on capital punishment on Thursday, saying courts need to slow down appeals processes to consider DNA evidence that could potentially prove a defendant is innocent.

Clinton's comments came less than 24 hours after the state of Georgia executed Troy Davis, a man convicted of shooting an off-duty police officer. Davis' case sparked protests around the world from supporters who believed he was innocent, due to a lack of physical evidence tying him to the crime and seven witnesses recanting their original testimony.

&quot;In any case where there's any chance that any DNA evidence could change the outcome of the trial -- I think that -- this is just me now -- I think that the appeals process has to be slowed down and organized so that any evidence of innocence can always be presented and then acted upon,&quot; said Clinton.

In a meeting with a small group of reporters and bloggers at the annual Clinton Global Initiative conference in New York, Clinton said he had followed some coverage of Davis' case but wasn't familiar with all the details, calling it &quot;unusual&quot; and declining to say directly whether he agreed with what had happened.

After Georgia was forced by the United States Supreme Court to abandon its scheme to deny Black people the right to an undiluted vote and representation, Leroy Johnson became the first Black person elected to the Georgia State Senate since Reconstruction.

The year was 1962. During his tenure, Johnson used his considerable influence inside the body to become the Senate's Chair of the Judiciary Committee. From this position, he was able to bottle-up legislation that was bad for the State of Georgia, especially its Black residents. Outside and inside the State Senate, Leroy Johnson practiced the art of leadership and engaged in the fight for justice. He produced solid results for a people who were hungry for justice.

Who among our elected officials today exercises the art of leadership in an engaged struggle for justice? Sadly, the numbers are way too small. It is more expedient to exchange silence for merely &quot;being there,&quot; in the end exercising no leadership at all and becoming a spectator to power in abandonment of those who need the effective use of power the most. The art of the struggle has veritably been abandoned for merely occupying a seat at the table when the purpose of the struggle for the seat at the table was to empower the struggle for justice. The only reason we send people to occupy that seat is to leverage the power of the community where power is exercised, on behalf of those who need it the most.

As I was commiserating over the Troy Davis situation with a former member of the Georgia Legislature who rose to the highest possible position within that body for his party, he lamented that for all of his years in the Legislature, he had not introduced a single death penalty bill. I quickly interjected that he was so busy putting out other fires and sticking his fingers in all the holes of the leaky dikes and schooling his colleagues on the effective use of the power of their elected positions that he couldn't do everything. It will be interesting to see what legislative actions his former colleagues will initiate in the face of this clear act of barbarism by my state.

Occupying these &quot;seats at the table&quot; is important. Engaging in the struggle for justice is important. And contrary to what many would have us believe, leadership is important. That's why so much effort is spent on co-opting or marginalizing the leaders of conscience that we do have and preventing authentic representatives of our values to occupy those seats at the table.

Therefore, more is required of us. We must hone the skill of discernment. We must not give our vote to just anybody to occupy these positions of power. We must not allow &quot;posers&quot; to represent us. Posers are those who wear the jackets of authority, who are put in positions of power by us, but who do not engage in the artful use of that power on our behalf. Discerning who is friend and who is poser has been difficult. But, is being made more possible by the arrogance now of those who do not have the interests of the people at heart. They seem not to care that their &quot;neanderthal&quot; is showing. But we can look at them and clearly see that they ain't us. Their actions are a clue that they do not share our values.

Unfortunately, posers exist all around us: and in the media, too. The job now of people of conscience is to make sure that we don't enable these posers by our own supportive behavior. My friend reminded me that Leroy Johnson, alone in the Georgia State Senate, was more powerful in the 1960s than are the 55 Black members of the Georgia Legislature now. We need to stop and think about that.

More is less? What role have we all had to play in such a circumstance? Is our leadership more of a reflection of who we are than we have acknowledged? What can we do differently in order to get a better result?

As the United States and NATO drop bombs on unsubmitting African people in Libya, the United States kills an innocent Black man in Georgia. There is more to come unless we affirmatively take steps to stop it. Republican voters cheered at the prospects of more executions at a recent Presidential debate. In a recent article, Africom brags on its lessons learned from Libya:

It's distressing but not surprising.
America has a pattern of injustice against black people.
There are men who were convicted based on confessions extracted using torture methods who are still struggling to get retrials.
