The Mystery Of Ray Gricar, The Prosecutor Who Failed To Prosecute Jerry Sandusky (And Who Might Be Dead)
On April 15, 2005, Ray Gricar, the Centre County district attorney, left his office in the county's brick-and-limestone courthouse, got into his red Mini Cooper and drove away. He called his girlfriend, Patricia Fornicola, around 11:30 a.m. to say that he was traveling on Route 192. That was the last anyone heard of Ray Gricar.

Fornicola reported her boyfriend missing that night. The next day, Gricar's car was found in a Lewisburg, Pa., parking lot with his cellphone inside. Three months later, fisherman on the nearby Susquehannah River discovered Gricar's county-issued laptop in the water, wedged against a bridge. The hard drive was missing. Three months after that, police found the drive on the riverbank, damaged so badly that no data could be recovered. Four more years would pass before investigators would reveal the internet searches someone had run on Gricar's home computer before his disappearance: &quot;how to wreck a hard drive,&quot; &quot;how to fry a hard drive,&quot; and &quot;water damage to a notebook computer.&quot;

The details about the prosecutor's disappearance were, to say the least, suspicious and alluring. Newspapers around Pennsylvania picked up the story. America's Most Wanted profiled Gricar. The Discovery Channel launched an investigation. And strange theories proliferated. Someone claimed to have seen Gricar sitting in the Oprah studio audience. Another person snapped a photograph of a man who looked like Gricar eating at a Chili's in Nacogdoches, Texas, four months after his disappearance. The local police even agreed to work with a California psychic in the hopes of turning up a lead.

No leads presented themselves. In July of this year, Gricar's daughter successfully petitioned a court to declare Gricar deceased and bring the saga to an end. But the saga will not end. That's because Gricar is the man who may have let Jerry Sandusky off the hook in 1998, when reports first surfaced of Sandusky's sexual misconduct (showering with an 11-year-old boy). From The New York Times yesterday:

[A]s the Sandusky investigation moves forward, questions will be asked anew about why Gricar did not pursue charges against him 13 years ago. A small but strident minority believes Gricar did not want to tackle a case that involved a hometown icon. Others who knew and worked with Gricar say he was a meticulous, independent and tough-minded prosecutor who was unbowed by Penn State, its football program and political pressure in general

Gricar was, according to people who knew him, a cautious but hard-nosed prosecutor who didn't shy away from high-profile cases. His disappearance came right after he'd broken up a major heroin-trafficking ring, the county's biggest drug bust at the time. It's hard to imagine a guy willing to take on heroin dealers who wouldn't go after a pederast.

Maybe Gricar was killed or committed suicide or intentionally dropped off the grid. If anyone would know how to hide his trail from investigators, it'd be a district attorney. The natural conspiracist in all of us craves a good story. And if Gricar's disappearance has something to do with Sandusky, that'd sure make for a greasy little secondary narrative in this colossal trough of turpitude. For now, though, it'll have to remain a mystery.

I was wondering if they had also fired the Athletic Director, Tim Curley, but I just read that he and Senior Vice President Gary Schultz,, were charged with perjury and failure to report the allegations.

And now that the Department of Education is investigating - wonder if this means locking down federal funds for Penn State

When the news broke that Sandusky was indicted on 40 counts of sexual abuse and Curley and Schultz were charged with perjury and failure to report, Spanier released a statement saying Curley and Schultz &quot;have my my unconditional support,&quot; adding &quot;I have complete confidence in how they have handled the allegations about a former University employee.&quot;

The mother is upset that Spanier was so vocal in his support:

&quot;I'm so upset,&quot; said the mom of the 24-year-old, who authorities are calling Victim Six. &quot;My son is extremely distraught, and now to see how we were betrayed, words cannot tell you. To see that Graham Spanier is putting his unconditional support behind Curley and Shultz when he should be putting his support behind the victims, it just makes them victims all over again.&quot;

The same mother also unloaded on McQueary, who testified that as a 28-year-old graduate assistant in 2002 he witnessed Sandusky sexually abusing a young boy but did not make an effort to stop him, instead calling his father for advice before reporting the incident to Joe Paterno:

But on Friday, March 1, 2002, in an episode that those close to McQueary say left him shocked and confused — and that would return to haunt his life and the fortunes of his university years later — he entered the locker room in Penn State’s Lasch Football Building at about 9:30 p.m. to put a new pair of shoes in his locker and pick up some recruiting tapes, according to the report of the grand jury that investigated the allegations involving Sandusky. Coaches commonly keep late hours but not so much in the off-season months, like March. Besides, the lights were not on in the offices, but toward the locker room. That is not usual. And a shower was running.

According to the report, McQueary heard “rhythmic, slapping sounds,” which he believed to be those of sexual activity. He walked to his locker, opened it and put his sneakers inside. He then turned his head and looked into the shower.

He has said under oath that he saw Sandusky raping what appeared to be a 10-year-old boy. He immediately left, met with his father and determined he would report the incident to Paterno, according to prosecutors. A person familiar with his account said McQueary did not spare the details when he met with Paterno. Nor did he when he met with the university’s athletic director and another senior administrator, the man in charge of Penn State’s campus police.

Weeks later, according to state prosecutors, those officials told McQueary that Sandusky had been barred from bringing children onto campus.

To date, it is unclear whether McQueary was satisfied or outraged. But there is no evidence that he did anything else to see Sandusky more meaningfully investigated or punished.

What he did do was continue his climb up the ranks of Paterno’s coaching staff.
By 2004, he was named the wide receivers coach and recruiting coordinator in a staff shakeup after a dreadful 3-9 season. He replaced Jay Paterno, Joe’s son, as recruiting coordinator, and when the 2005 team went 11-1, a boost in the program’s recruited talent was lauded for the turnaround.

Over time, still so visible on the sideline because of his red hair, McQueary came to be known as the coach Paterno yelled at when things went wrong. He was often at Paterno’s side, relaying plays called from the coaches’ box upstairs to the quarterback on the field.

“Everyone wants to know what Coach is saying to me when he’s yelling at me,” McQueary, who is married with a young daughter, told a Pennsylvania newspaper in August. “It’s really everything under the sun. It’s something different every time. Coach has a knack for saying things or thinking about things during the course of a game that some of us aren’t thinking about. It’s like anything you do in life. If you’re not emotional, animated or intense about it, then why do it?”

At about that time, in an interview with The New York Times Magazine, McQueary said he dreamed of one day coaching the Nittany Lions, then added, “But Joe will probably outlive me.”

In the last few months, after injuries to Paterno, who is 84, relegated him to watch games from the coaches’ box, he chose to communicate with one coach on the sideline via a headset: McQueary, his long-time-ago graduate assistant.
