A Canadian man sits in a Jamaican prison Wednesday night after his wife's throat was slashed near the resort area of Montego Bay.

Paul Martin is charged with attempted murder and remains in custody after being denied bail during a preliminary hearing Tuesday.

His wife, Cathy-Lee Martin, had been in the Caribbean nation since she was attacked on Dec. 23. She arrived back in Canada late Wednesday afternoon.

Earlier, with bandages covering wounds on her neck and thumb, she tearfully testified before a judge in a Falmouth, Jamaica, courtroom and accused her husband of twice slitting her throat and trying to strangle her in a failed murder attempt.

"She's under no misapprehension as to what happened to her and who did it," Cathy-Lee Martin's lawyer, Nathan Robb, told reporters outside the courthouse.

The alleged attack occurred the day the Ajax, Ont., couple, which has two kids aged five and two, was scheduled to leave Jamaica after a weeklong vacation.

Paul Martin, a fifth- and sixth-grade teacher at St. Francis de Sales Catholic School in Ajax, allegedly told his 34-year-old wife he was taking her on a sightseeing tour before heading to the airport but drove their rental van into a secluded area and allegedly attacked her, the Jamaica Observer newspaper reported.

Cathy-Lee Martin, a bank manager, alleges her husband became violent because he mistakenly believed she was cheating on him, the newspaper reported.

The Martins reportedly travelled to Jamaica to mend their strained relationship.

Despite her serious injuries, Cathy-Lee Martin was able to escape the van and flag down a passing motorist who pursued the suspect's vehicle down the road, she told court.

A passing taxi driver picked her up and drove her to a hospital, where she underwent emergency surgery.

Speaking via telephone from Falmouth, taxi driver Lenworth Blake who claimed to have witnessed the incident, told CTV News Channel that after passing the van on the road he looked in his rear-view mirror and was surprised to see a woman's legs sticking out of an open passenger-side door.

Clearly suspicious, Blake decided to turn around and investigate. He located the van and a woman, who was standing nearby and covered in blood.

"She was bleeding, so I told her, ‘Get in.' After she (got) in she told me her husband was trying to kill her," Blake said.

In his defence, Paul Martin told police investigators his wife was attacked by a stranger during a robbery attempt, said Det. Sgt. Pheonia Watson of the Jamaica Constabulary Force.

However, further investigation foiled that claim, Watson told CTV News on Wednesday.

Paul Martin was present at Tuesday's court hearing. So were members of Cathy-Lee Martin's family, according to the Jamaica Observer.

For now, Paul Martin sits in a Jamaican jail pending his next scheduled court appearance is in January.

"He himself is very traumatized. His primary concern is about his children … and he is very, very concerned about his wife," said Ernest Smith, Paul Martin's attorney.

Residents of Ajax expressed shock at the allegations.

"We just don't believe it. He's a real gentleman. We had a couple laughs together and he's great with the kids," said Leo Giovannelli.

He added that his daughter Kristina, a Grade 6 student who was being taught by Paul Martin at St. Francis, is "coping."

"I guess I'm fine, but I'm kind of shocked. He was such a good teacher. What am I going to do?" Kristina said. "It's hard a little bit. But I guess it's happening -- we have to deal with it."

Students and parents at the school will be offered counseling after the holidays, said Kathy Lefort, Chair of the Durham Catholic District School Board.

this is probably another example of one of the major problem they have in the legal system in the Caribbean.. the laws have outstripped the capability of the police to collect evidence and the prosecutors to present a case...i bet anything he got off on some little technicality like the knife wast entered into evidence properly or the knife expert was not gazetted in Jamaica.

Jury frees Canadian charged with trying to kill his wife

vacation in Jamaica, was freed before the Hanover Circuit Court Tuesday afternoon [November 22].

Paul Martin, 43, was freed after a seven-member mixed jury returned a verdict of not guilty on one count of wounding with intent and unlawful wounding.

Mr. Martin was charged after he reportedly slashed his wife's throat in Trelawny in December last year.

Government prosecutors led evidence that Mr. Martin slashed his wife's throat on a deserted road in Stewart Castle, Trelawny.

His Canadian wife, Cathy Lee Clayson, who survived the attack, gave testimony at the trial, in which she stated that her husband tried to kill her.

She accused him of slitting her throat twice, adding that he also tried to strangle her.

She testified that she was traveling to the airport with Mr. Martin when he drove onto a lonely road and attacked her.

However, Mr. Martin strongly denied the allegations.

He testified that she was the one who pulled a knife on him and attacked him.

He contended that he was trying to disarm her when she got cut on her throat.

Complainant disappointed

Mrs. Martin's attorney, Nathan Robb, told RJR News that his client is bitterly disappointed with the verdict.

"The jury system was at work and the jury came back with a decision, which as an experienced attorney, I am accustomed to expecting the jury verdict and respecting it. The complainant however, remains resolute that she gave the evidence as to what happened and she was in no way discredited and I dare say that after almost two days of deliberations, she stood up very well but the jury is the ultimate arbiter of the facts," he said.

The jury decided – DPP

And Paula Llewellyn, the Director of Public Prosecutions (DPP), who marshalled the evidence, said she respects the verdict of the jury.

"The system of justice in Jamaica means that we always have to respect the verdict of the jury, whether we agree with it or not. The complainant (and) the Jamaican witnesses gave excellent evidence however, in the final analysis; the decision was for the jury.

"The complainant has commended the prosecution’s team for having been extremely professional and having put out our best, however, in the final analysis, the jury decided that the accused was not guilty," Miss Llewellyn said.

After reading about it in today's Observer I can see why there might of been enough &quot;doubt&quot; for the jury to decide he is not guilty.

Not saying this guy is guilty or not but there is a theme across the Caribbean and Mexico that started with Aruba. Do your crimes there and you may get away.

PAUL Martin, the Canadian school teacher accused of slashing his wife's throat while the two were on vacation in Jamaica, was yesterday acquitted by a panel of seven jurors who deliberated for approximately 60 minutes.
The verdict was unanimous.
Martin had been on trial in the Hanover Circuit Court as a result of the incident that occurred last December as the couple stopped to take photographs of the Jamaican scenery while on a side road in the parish of Trelawny on the last day of their vacation. The two, according to the prosecution, went to the location on the accused man's suggestion.
But from the outset the accused professed his innocence. He stated in his defence that it was his wife who first attacked him and that she received her injuries while the two grappled for the knife as he tried to prevent her injuring him.
During the trial, the wife denied that after she was injured her husband asked her for the knife. But when confronted by the defence with the statement that she gave to the police on the day of the incident, she said that her husband had asked her for the knife after she received her injury.
<span style="font-weight: bold">She also admitted that it was she who, after the incident, suggested that they make up a story that the injury was as a result of a robbery.</span> She also admitted to the prosecutor that her husband is a good and honest man and a great father who had never, prior to December 2010, been physically violent to her or their children.
During her two days of cross-examination, the wife admitted that, on returning to Canada, she immediately took steps to freeze her husband's assets after learning that he had made their two young children beneficiaries of his pension scheme and insurance. Her action, she said, was designed to prevent him accessing his money to pay his Jamaican lawyers.
Five witnesses who travelled from Canada to Jamaica to testify on behalf of the defendant confirmed his good character and said that he was a man of integrity who was respectful and considerate towards women and committed to family life.
Martin was represented by Jacqueline Samuels-Brown, QC, Bert Samuels, Delford Morgan and Roxanne Mars. The Crown was represented by Director of Public Prosecutions Paula Llewellyn, QC, and Joan Barnett.
