<span style="font-weight: bold">CORPORAL Dwayne Smart, the police officer who shot and killed a heavily pregnant St Thomas woman and injured her sister on the weekend, is to be slapped with murder and other charges.</span>

<span style="font-weight: bold">Yesterday, Acting Director of Public Prosecution, Lisa Palmer-Hamilton ruled that Smart be charged with murder, illegal possession of firearm, wounding with intent, and assault.</span>


Upon the charging of Smart, the prosecution is expected to skip the preliminary enquiry stage of the case in the St Thomas Resident Magistrate's Court and have the matter transferred to the Home Circuit Court in Kingston. The circuit is expected to be reopened on September 17.

<span style="font-weight: bold">Twenty-seven-year-old Kayann Lamont, who was a month away from giving birth, was shot in the head in Yallahs square by Smart following a tussle. Smart had accosted Lamont over the use of indecent language.</span>

Her sister, Novia Lamont, was shot in the shoulder while running to her aid. Another sister, Shemean Lamont, was allegedly assaulted by the cop, who also turned the gun on her. However, the weapon did not fire.

<span style="font-weight: bold">Smart reportedly had to be restrained by colleagues on the scene.</span>

Both women were taken to the Princess Margaret Hospital where Kayann was pronounced dead and Novia admitted. She was released from the hospital yesterday.

The family has since contracted the services of former Justice Minister Dorothy Lightbourne to get compensation from the State over the incident.

The incident, which allegedly happened in front of several eyewitnesses, has drawn widespread condemnation, including from the rights group Jamaicans for Justice, the Opposition Jamaica Labour Party and its affiliate Generation 2000.

In the meantime, the Police High Command, speaking for the first time since the incident yesterday, expressed regret at the shooting and pledged to take all possible steps to minimise the use of force in their interaction with citizens.

&quot;The killing of Miss Kayann Lamont and injuring of her sister... is a terrible tragedy which is deeply regretted,&quot; a release from the Constabulary Communication Network said.

The high command emphasised that Smart was taken into custody the same day of the shooting and investigators from the Independent Commission of Investigations (INDECOM) were contacted.

&quot;Other officers who were present at the time of Miss Lamont's killing have been made available to the INDECOM investigators to be interviewed. All weapons in possession of the cops on duty at time have also been seized and taken to the forensic lab for examination, and the policemen's hands swabbed,&quot; the release stated.

Additionally, the high command said that police chaplains have been deployed in the community since Sunday, and have been providing counselling for the affected families and that an administrative review of Saturday's operation will be conducted on September Friday.

&quot;The Police High Command is appealing to everyone to allow the investigations to proceed in a fair manner.

&quot;Where our members are concerned, this incident demands that we reflect deeply on how we engage citizens in conflict situations as we are committed to improving our operations,&quot; the release stated.

On Saturday, her three daughters - Kay-Ann, Novia and Shemean Lamont - had just returned from back-to-school shopping in downtown Kingston, and stopped by their cousin Byron Williams' stall at Yallahs Square in St Thomas. <span style="font-weight: bold">They were awaiting a robot taxi to head home to Logwood.</span>

McCloud said the police officer, who was on patrol with a group of others, overheard and told 27-year-old Kay-Ann that she could be arrested for using indecent language. She reportedly responded that everyone used them and broke down the two words and asked him what they meant.</span>


The officer reportedly then held on to her hand and attempted to take her to the police station a few yards away. She resisted and her sisters protested. In the attempt to take her to the station, eight months pregnant Kay-Ann and the officer reportedly fell in the road.

Eyewitnesses said they began to laugh, which later turned to screams as the officer just &quot;get vex and jump up&quot;, brandished his firearm and shot the pregnant mother of two twice in the head while she was still on the ground. He then reportedly turned his gun on Novia, who attempted to run, hitting her in the left shoulder.

Witnesses said he then turned the gun on Shemean, who ran and hid behind a market vendor.

<span style="font-weight: bold">The religious community and police force in Yallahs, St Thomas, are in shock over what could have caused their church brethren and colleague to allegedly kill a pregnant mother of two and attempt to kill her two sisters.</span>

&quot;This is really, really surprising to me. I am still at a loss as to why this happened, as are a lot of the community members, members of the police force in St Thomas and his church brethren,&quot; said Deputy Superintendent Patrick Bennett, in charge of operations for St Thomas.

&quot;He is a community-oriented person, who born and grow up in Yallahs. I have known him all his life. I know his father who was a policeman, who has now retired and is living abroad.&quot;

On Saturday, following an altercation with one of three sisters in the Yallahs Square, the policeman reportedly shot 27-year-old Kay-Ann Lamont twice in the head, killing her on the spot. She was eight months pregnant.

The policeman then reportedly shot her sister Novia and attempted to shoot their other sister, Shemean, who said she had to run and hide behind a market vendor.

According to eyewitnesses, had he not been restrained by a fellow policeman, he would have probably killed all three women.

Novia has been hospitalised with a gunshot wound to the left shoulder, while Shemean told The Gleaner: &quot;I am still in shock and terrified. I still can't believe what happened.&quot;

Shemean said the women were protesting the policeman's treatment of their sister, after she used indecent language in his presence and he attempted to arrest her, but she resisted.

<span style="font-weight: bold">Bennett said the policeman was himself in shock and was under a <span style="text-decoration: underline">suicide watch</span> because of his distraught mental state.</span>

&quot;He is very distraught and is undergoing counselling. He is really traumatised and we have to have people around him all the time,&quot; said the deputy superintendent, who operates from the Morant Bay Police Station.


Bennett said what was more surprising about the officer's action was that he is a Christian, a member of the choir at the Yallahs New Testament Church of God, a member of the Jamaica Constabulary Force Christian Association and a member of the St Thomas arm of the Community Safety and Security Outreach programme.

The accused policeman, who has been a member of the police force for more than 12 years, was stationed at the Morant Bay Police Station and later transferred to Llandewey before moving to the Yallahs Police Station two years ago, when he was promoted to corporal.

The corporal, who is reportedly in his mid 30s, lives in the Yallahs community with his wife and two children and is known by several of the residents.

<span style="font-weight: bold">One church sister, who declined to be named, said on the Sunday and Wednesday before the shooting, the policeman had got up in church to testify and asked them to pray for him.

&quot;Him say from him get promotion people a try do him something and him a beg we fi pray for him. Him really did a behave strange from weh day. Me just feel somebody do him something fi him do dis. Believe me, dis a nuh him. A nuh him dis weh do dat,&quot; she said.</span>

Policeman taken into custody, family placed under protection

<span style="font-weight: bold">The family of the policeman implicated in the shooting death of a woman and the injuring of another in Yallahs, St Thomas has been placed under police protection while he is taken off front-line duty.</span>

A release from the Constabulary Communication Network (CCN) this morning says the policeman has been taken into custody while the Independent Commission of Investigations (INDECOM) and his counterparts investigate the incident.

A 25-year-old pregnant woman was fatally shot and another woman injured yesterday when the policeman allegedly attempted to arrest one of them for using expletives. The shooting caused residents of the community to become irate as they used debris to block the road.

The CCN says a police team has been deployed to protect the family of the policeman implicated in the shooting, while personnel from the police's chaplaincy unit have been deployed to offer counseling to both families.
