The Inter-American Development Bank (IDB) has formerly approved the US$600 million ($53.7 billion) in loans for Jamaica adding that they are not contingent upon the extradition of Tivoli strongman Christopher 'Dudus' Coke.

&quot;Absolutely not,&quot; stated Dan Zelikow vice-president of the IDB in response to Business Observer queries after a press conference at the Ministry of Finance in Kingston, last Wednesday.

<span style="font-weight: bold">The Government has already received some US$200 million since January and the remainder will be disbursed within the year. </span>

<span style="font-weight: bold">Zelikow was initially ignorant of the stalemate between the US and Jamaica regarding the extradition of Coke, when queried by the Observer during the press conference. Finance minister Audley Shaw, however, interjected, arguing that the IDB would not issue conditionalities tied to US policy because it was not governed by US dictates</span>.

&quot;The IDB is a multilateral institution we are not talking about a bilateral situation, the IDB is multi-country institution and has 49 member countries,&quot; argued Shaw.

Zelikow added: &quot;We at the IDB are categorised as an international civil servants it just so happens that some of us have US passports&quot;.

The IDB is a multilateral institution however the US is its single largest shareholder accounting for one-third of its capital which equates to voting power.

&quot;Each member country appoints a governor, whose voting power is proportional to the Bank's capital subscribed to by the country. The 26 Latin American and Caribbean countries in the IDB hold 50 per cent of the voting power; the single largest shareholder is the US with 30 per cent,&quot; states the IDB organisational structure posted on its website.

Zelikow's visit and press conference comes a day after Prime Minister Bruce Golding defended his administration's decision to refuse the US extradition request for Coke, on the grounds that the Americans obtained evidence illegally.

Zelikow who will return to IDB headquarters in Washington US on Thursday met with Prime Minister Bruce Golding and Shaw to &quot;congratulate them&quot; for actions taken to deal &quot;decisively&quot; with the country's fiscal challenges.

Jamaica had executed a voluntary debt swap, reached as a conditionality of the US$1.2 billion stand-by arrangement with the International Monetary Fund (IMF) last month.

&quot;The success of this debt swap is a testament to the investment community's confidence in Jamaica's plan for improving debt dynamics,&quot; said Zelikow. &quot;Jamaica is now in a position to stabilise its finances, accelerate its economic recovery, attract increased investment and generate more jobs. The IDB is committed to support this new chapter in Jamaica's development with one of the largest lending programs we have ever approved, relative to a country's GDP.&quot;

Jamaica's voluntary debt swap registered a participation rate of more than 99 per cent and will result in Government saving some $40 billion on interest cost payments in its first year -- due to a reduction in interest rates and extension of debt maturities.

Zelikow said that the loans would support several aspects of Jamaica's reform agenda, including improvements in fiscal management and the introduction of fiscal responsibility legislation, initiatives to enhance information in credit markets and remove distortions in the tax system, and support for social programs such as the PATH cash-transfer mechanism.

THE NATION'S most powerful group of business leaders, the Private Sector Organisation of Jamaica (PSOJ), has joined other associations and individuals in disagreeing with the Government's decision not to sign the extradition request for west Kingston strongman Christopher 'Dudus' Coke.

The PSOJ set tongues wagging islandwide yesterday as it came out with a position far removed from the stance of the Bruce Golding administration.

&quot;This shows that the extradition issue is affecting the business community and reflects what many people have been saying: that the Government is mishandling the extradition request,&quot; Richard 'Dickie' Crawford told The Gleaner minutes after the PSOJ release was circulated.

Crawford said the PSOJ's statement argued that the questions surrounding the request from the United States for the extradition of Coke should be determined in a court of law.

The PSOJ said: &quot;... We call on the Government to expeditiously take those steps necessary to allow the Jamaican courts to assess and determine the merits of any outstanding extradition requests by the United States, confident that our courts will have every regard for the rights of citizens, as enshrined in Jamaica's Constitution.&quot;

Fears implications

According to the PSOJ, it views with grave concern the content of the recently released US Narcotics Control Strategy Report and the implications it could have for the country.

The PSOJ said it had noted the statement made by Golding in Parliament on March 2 when he argued that the attorney general could not sign the extradition request because the procedures that were employed by the American authorities were abnormal.

In that presentation, Golding also argued that in one important respect - the interception of communication - the extradition request was found to be in violation of the Jamaican law, and rejected a call from the opposition People's National Party to have a court of law rule on the issue.

But the PSOJ yesterday sided with the Opposition.

&quot;While we would not wish to comment on the veracity of the contentions made in the referenced report, or indeed, the prime minister's basis for the handling of the matter as set out in his statement to the Parliament, it seems to us that the proper forum for these matters to be dealt with in a transparent manner is in the courts of Jamaica.

&quot;We believe there are sufficient safeguards available in Jamaican law and in our independent judiciary to protect the constitutional rights of all Jamaican citizens,&quot; the PSOJ added.

The private-sector group also noted: &quot;Jamaica, being a part of the international community, acknowledges the transnational nature of crime and the need for a concerted global effort to eradicate crime and violence.&quot;

According to the PSOJ, Jamaica has demonstrated its commitment to fight criminality by signing the relevant international treaties and in enacting the necessary domestic legislation to facilitate cooperation.

TEGUCIGALPA, Honduras — Stung by the loss of their American visas and concerned about Honduras’s increasing international isolation, the country’s leading businessmen have put forward their own plan to resolve the political crisis here.

In the plan, which was made public earlier this week, supporters of the coup that ousted President Manuel Zelaya three months ago have for the first time suggested his return as president. But at the same time the plan calls for him to face trial on charges that he stole money while in office.

“What we’re trying to do is break the ice,” said Adolfo J. Facussé, president of the country’s manufacturing association.

Mr. Facussé said he had put forward his own proposal because he thought that other countries, particularly the United States, were preparing to reject the results of a presidential election scheduled for Nov. 29. The State Department has warned that it may not accept the results if there is no political agreement.

“They continue deteriorating our elections process,” Mr. Facussé said. “This is the most destructive thing they can do in a democracy.”

He added, “The less support the candidates have, the less they can do to solve the problems.”

The United States has stepped up sanctions in stages in an effort to press the de facto government of Roberto Micheletti to negotiate with Mr. Zelaya. After initially suspending military aid and then some economic aid, the United States said in early September that it would revoke visas to members of the de facto government and their supporters.

When Mr. Facussé arrived in Miami on Sept. 12, immigration officials told him that he was no longer welcome. The United States Embassy declined to say which other business leaders had had their visas revoked.

Christopher &quot;Dudus&quot; Coke.Jamaica is getting more negative publicity in the wake of the government's refusal to sign an extradition request for West Kingston strongman Christopher &quot;Dudus&quot; Coke.

A little over a week after the highly controversial issue was placed in the international spotlight via a US State Department report, the widely circulated The Economist magazine has brought more attention.

On Thursday, The magazine published a report which claimed that the American authorities have become more frustrated with the Government's foot dragging in granting a US request to hand over Mr. Coke to answer gun and drug running charges.

The article titled &quot;Seeking Mr. Coke,&quot; places the country in an extremely negative light as it outlines among other things the close connection between Mr. Coke and the governing Jamaica Labour Party.

The no holds barred report says the US Justice Department has put Mr. Coke on its world's most dangerous list, accusing him of directing drug deals as far away as New York.

It goes on to state that if American allegations of political links are well-founded, some Jamaican public figures may fear that Mr. Coke's arrest would lead to the disclosure of embarrassing information.

According to the Economist, it is rumoured that Mr. Coke has deposited incriminating documents with lawyers, to be released in the event of his untimely death.

However, it noted that in pressing for Mr. Coke's extradition, the United States must also be aware of the risk that his arrest could further destabilise Jamaica which has already been racked by drugs-related violence.

This talk about letting the courts decide got me thinking. On the surface, there <span style="font-weight: bold">seems</span> to be some deference to judicial independence, but I think this is all a plan to send off Dudus, to the States. Implicit in this push by some, it seems to me, is the assumption that the courts will rule in favour of the US. Opponents of the government would rejoice on scoring some political points, and even those allies of the government will get to say &quot; see, the PM stood up against the mighty Uncle Sam, he did his best, but the courts have decided and we have to respect the independence of the court.&quot; And in this way, as the poster said above, the government would wash its hands of the matter.

But would the court decide in the US's favour? I cannot think of any court on the face of this earth that conducts its affairs with the utmost integrity that would rule for the US in <span style="font-weight: bold">this particular circumstance</span>. The court would be asked to decide if evidence obtained by illegal means by a foreign power, without the consent of Jamaican authorities (law enforcement or a Jamaican judge with jurisdiction on these matters) should be acceptable in this extradition request. For a judge with integrity, the answer is an unqualified NO! Unless there are some who have reason to believe that the court will rule - <span style="font-weight: bold">in violation of the constitution</span>. I would go as far as to say that any judge who rules against the Attorney General in this matter should not only be removed from the bench, but prosecuted on corruption charges.

I'm wondering, why is this so hard for the PNP to understand, or is because they are more interested in political grandstanding? And the PSOJ ought to know better; their latest outburst smacks of hypocrisy. We should note here, that if things were reversed and this was an extradition request made by Jamaica to the US, with <span style="font-weight: bold">illegally obtained evidence</span>, the Attorney General, Eric Holder, would probably put this document in a 'safe place' - in the event that he runs out of toilet paper. In American jurisprudence, this request would have been easily shot down under the Exclusionary Rules of the Bill of Rights. And Jamaica, with it's laws derived from the British legal system (on which many of America's legal principles are also based, BTW) has its version of the &quot;Exclusionary Rules&quot;.

Moreover, according to the Extradition Treaty between Jamaica and the US, it is the Attorneys General of both countries who have the responsibility of reviewing extradition requests, not the courts. So, the attorney General of JA is acting well within the terms of the extradition treaty.
