Prior to August of 1962 Jamaicans were British citizens. He went to England as a British Citizen but on the day Jamaica gained independence all Jamaicans living in England were no longer British citizens. They were all encouraged to take out passport for new country. You know a lot a people living in England at that time never understand the ramifications. So you go to sleep on Aug. 5, 1962 a British citizen and you wake up the next morning Aug. 6 and you have now become a Jamaican. It vexed my father to know end he kept insisting that he was a British Citizen (having been recruited and fought in war) and since he was born in 1911 but the British Government said no you are now a Jamaican. Eventually he took out his citizenship. Some people fell through the cracks - I can see how this happened to this poor man.

He went to England as a British Citizen and when Jamaica gained its independence on 8/6/62 people born in Jamaica and immigrated to England were no longer British - they were now Jamaicans. This man being only 7 years old at the time probably had no idea that he was no longer a British citizen and as for his parents some of them could only make a "X". I was there at 6 years old (I am a couple years older than this man). I still have my old British Passport but had to apply to become a British citizen all over again. They did not want any more "monkeys" in their country. As Peasie says at one time Enoch Powell even wanted to deport children born in England whose parents were born elsewhere (my own daughter came under this category).

Two black men had knocked on her door at 7 am to use her telephone to call their employers, but she refused, as she would have done to any other stranger knocking at her door at such an hour, and was subsequently verbally abused. She had asked her local authority for a rates reduction, but was told by a council officer to let out the rooms of her house. When the woman said the only tenants would be black, the council officer replied: "Racial prejudice won't get you anywhere in this country."

The diligence and duty is on the side of England completely and ought to account for and compensate him completely for these issues - I am sure some savvy wolfish lawyer is looking on a sterling payday.
I would love to represent him ..

They ought to have better policies and rules of engagement towards the people who they asked to come to their country to bolster their production and re-building process and be the under class on which the elevate themselves in that second manifestation of disguised and forced labour.
They ought to have advised him before he left that he could not do so, without issues.

Perhaps a whole range of people need to lose their jobs for allowing this man to leave the country " unless they have a plan for persons like him, whatever that may be and are simply executing that plan effectively.

The man is largely blameless for being stranded in the country and his expectations to return after leaving the country is completely in order. That he is not is a sad travesty...

He probably met his wife a farrin and settled down, purchased a home, raised a family, maybe saw his grandkids born into the world and yet it did not enter his mind that maybe he should apply for citizenship in the country where he had made a life for himself and his family? Was it just a thing of "mi cyaan badda". If so then he has no one to blame but himself.

I will agree that any official looking into the case and seeing the facts, should immediately give him a pass, but in this life, ultimately, you have to be responsible for your own actions, or lack of actions.

Expensive lesson learned, hopefully others will take note.

I agree with My Looh. I was young but recall my parents receiving notification by letter - in fact several letters that clearly set out the changes made to their British citizenship and the action they needed to take. (My mother cussed some "warra warra-it about it" ). I too think it was a case of "mi cyaan badda" with this gentleman as My Looh stated.

Is the gentleman saying he has not travelled overseas in 50 years? If so, was it all done on his Jamaican passport? As I'm sure when trying to (if he did) to renew his old UK passport in the past he would have been denied and informed of the reasons why.

There is two issues... the right to residency in the UK and the right to entry into the UK ... A very british solution... He had the right to residency not the right to entry! This was avery british solution.. .the immigration authorties did not do a yanki style witch hunt for people to prove their right to residency. They simply applied the rules based on the right to entry to the UK.

A few years back ok decades back there was changes to the nationalism act... that the children who were brought up to the UK were not entitled to citzenship without nationalisation... A friend of mine who was born in Jamaica and brought to the UK had traveled down to Jamaica a number of times on a Jamaican passport wanted to go to Jamaica....He discovered he had to be nationalised...or he would not have been able to return. At my urging he got nationalised..

My friend paid 23 pounds signed a form and that was that got a nationalisation ceretificate ...a group of us decided to go to Jamaica. He applied for a passport paid the extra 30 pounds got it 3 days ( I went with him to petty france where the offic was signed the pictures and declared thai i known him for x amont of years) ...The two of us decamped to Jamaica for fun and frollics in Central Jamaica.. He gave me his certificate of nationalism for safe keeping and i somehow it got chewed up with all of my educational certificates by damness..

But at the time as part of the anti rascism industry there was complaints by the talking heads that this was rascism a fight against black people ect .. Rather than start a campaign tell people to regularise their stay they did their usual moral indignation of stuff and fury. Course it all passed in law and it was ignored.

I know of three or four people who this stranded thing has happened to. Uusally they present the necessary paper work and show they have been resident working and what ever and they are let back in. The last case i know is the bortother of a promient internationally know sports star . He lived in the UK traveled from a child, travel down to Jamaica to resettle on a Jamacan passport.. The buisness failed and he wanted to go back to the UK. He got back in but there seems to be a four year rule...BA has in the past told people that if they fly down on a Jamaican passport without residency permit in it they wont get back in... and stronly urged them not to.... So this incident is hardly an unknown phenomena....



.And as i recall this change in lawa was a refocus partially to prevent immigration from Non EU and partially as a change to the law under the EU rules. then EU immigration was not an issue. This change in rules has bitten the UK as under thsi law it has led to fall in migration from Jamaica and other commonwealth countries and led to a flood of migration from the other EU countries.... (try buying a cpffee from the modern coffee shops in Londfon from an english person!!!!!!!!)
