Illinois Gov. Rod Blagojevich's surprising and defiant decision to appoint a replacement for Barack Obama in the Senate seat could lead to a racially-charged showdown in Washington.

On one side, Obama, who will become the country's first black president, has said former state Attorney General Roland Burris, the first black to win a statewide office in Illinois, shouldn't be seated because of the corruption case against Blagojevich.

On the other side, members of the Congressional Black Caucus are warning their fellow counterparts in the Senate not to block the appointment of someone who would be the chamber's only black member.

U.S. Rep. Bobby Rush forcefully backed Blajogevich's decision on the basis of race this week, warning the public not to &quot;lynch&quot; Blajojevich's Senate pick.

&quot;This is a matter of national importance,&quot; Rush said at the news conference announcing the selection of Burris for the job. &quot;There are no African-Americans in the Senate, and I don't think that anyone, any U.S. senator who's sitting in the Senate right now wants to go on record to deny one African-American for being seated in the U.S. Senate.&quot;

Other caucus members, without referring to race, still stood in favor of seating Burris.

&quot;Burris has been appointed by the governor and I think it would probably work to everybody's benefit,&quot; Maryland Rep. Elijah Cummings told FOX News. &quot;This is a guy who's 73 years old. Let him go ahead and serve the two years. He's probably not going to run again and then let somebody else come and run.&quot;

Obama overcame predictions that the issue of race would derail his 2008 presidential campaign. But no one could have predicted how race has become a factor in the battle over how to appoint a successor to Obama's Senate seat.

This brewing battle could trump any debate about race on the 2008 campaign trail. And Washington observers are wondering if it has the potential to distract the first incoming president and the Democratic-controlled Congress before it even gets down to legislative business.

In a statement released this week, Obama called for Blagojevich to resign, allowing for a lawful and appropriate process of succession to occur.

&quot;Roland Burris is a good man and a fine public servant, but the Senate Democrats made it clear weeks ago that they cannot accept an appointment made by a governor who is accused of selling this very Senate seat,&quot; Obama said. &quot;I agree with their decision, and it is extremely disappointing that Gov. Blagojevich has chosen to ignore it.&quot;

Obama said Gov. Blagojevich is entitled to his day in court but &quot;the people of Illinois are entitled to a functioning government and major decisions free of taint and controversy.&quot;

Burris has made it clear that he is coming to Washington on Tuesday. But Democratic leader Harry Reid, D-Nev., has made it equally clear that the Senate will use its Constitutional powers to block him.

Burris faces another obstacle in his own state: Illinois Secretary of State Jesse White is refusing to sign off on the appointment. Burris filed a motion with the state Supreme Court seeking to force White to sign it.

White, who is black, told FOX News that he can't sign off on the appointment because Blagojevich is under a &quot;cloud of controversy&quot; and added that race played no part in his decision.

&quot;The person could have been pink, blue, green or yellow. My mission and my attitude and my commitment is the same,&quot; he said.

But race is playing an increasing role in this ongoing saga. At a news conference Friday, about a dozen black activists said -- despite the legal cloud over Blagojevich -- the governor has the legal right to appoint Burris, adding that Burris is highly qualified.

William Walls of the Committee for a Better Chicago warns that if White doesn't certify the appointment and Sen. Dick Durbin doesn't support Burris, activists will work to defeat them in upcoming elections.

Burris also has received support from the Chicago Sun Times in an editorial Friday.

&quot;Secretary of State Jesse White, despite what Blagojevich's foes might wish, has no legal or constitutional grounds to refuse to sign off on the appointment,&quot; the editorial read. &quot;If a secretary of state could kill gubernatorial appointments merely because a governor is an unpopular goof, there would be no end to it.&quot;

The newspaper, however, added it would have preferred a special election or Blagojevich to step aside and allow the lieutenant governor to make the Senate appointment.

Without his credentials from White, Burris may not be able to get inside the Senate chamber. Attendants who man the doors of the Senate chamber will not permit Burris to enter the floor, a Senate Democratic leadership aide told FOX News.

Jim Manley, a senior spokesman for Reid, told FOX News a resolution to refer Burris' credentials to the Rules Committee would be offered if the certificate problem is resolved in Burris' favor.

But Reid's original intent of blocking Burris would still stand, Manley said.

&quot;He will not become a U.S. Senator,&quot; Manley said, stressing that this is about Blagojevich, not Burris.

I do not quite know what he has done yet, but since we are into the everyone know. I would say that everyone one knows if you are caught out in public in such a compromising position, especially if you were under investigation for a number of years then you don't flaunt whatever power you have left, you try to play it down.

WASHINGTON – Roland Burris failed in his bid to take President-elect Barack Obama's Illinois Senate seat on Tuesday in a scripted piece of political theater staged just before the opening of the 111th Congress.

&quot;My credentials were not in order, I will not be accepted, I will not be seated,&quot; Burris, 71, told a mob of reporters who had followed him across the street for a news conference in a cold and steady rain outside the Capitol.

The former Illinois attorney general said he was &quot;not seeking to have any type of confrontation&quot; over taking the seat that he was appointed to by embattled Gov. Rod Blagojevich. But Burris, who would be the Senate's only black member, also said he was considering a federal lawsuit to force Senate Democrats to seat him.

It was a major distraction for majority Democrats eager to project an image of progress with Obama on an economic stimulus package that could cost up to $1 trillion.

Democrats and Obama have said that the corruption charges against Blagojevich would strip credibility from anyone he appoints to the seat. Burris and many of his supporters have suggested that the real reason for the rejection involved race.

Blagojevich denies federal accusations that he tried to sell Obama's seat. Democrats, for their part, deny that race has anything to do with Burris' rejection and say that it's a reflection on Blagojevich.

That Secretary of the Senate Nancy Erickson turned away Burris was no surprise; Senate Democrats had warned for weeks that if Burris showed up to be sworn in on Tuesday without the signature of the Illinois secretary of state, he would be turned away. That's just what happened.

But if what Burris really wanted a circus, he got one.

A mob of reporters awaited him outside the Senate's North Door, where Sergeant at Arms Terrance Gainer and a throng of officers escorted him through security and up to Erickson's office on the third floor.

There, more reporters waited. Once again Burris went through a metal detector and into Erickson's office, nestled between the elevators and the press gallery.

Twenty-one minutes later, Burris left; a spokesman for Senate Majority Leader Harry Reid confirmed that Burris had been rejected.

Burris left the building, escorted by Gainer and his officers.

And soon, a noisy throng of reporters followed him across the street, and Burris confirmed that he'd been turned away.

An attorney for Burris, Timothy W. Wright III, said that &quot;our credentials were rejected by the secretary of the Senate. We were not allowed to be placed in the record books. We were not allowed to proceed to the floor for purposes of taking oath. All of which we think was improperly done and is against the law of this land. We will consider our options and we will certainly let you know what our decisions will be soon thereafter.&quot;

Asked what his options were, Wright said there possibly could be a court challenge and he said that Burris also would continue to talk to the Senate leadership.

There had been earlier indications that the Senate would disallow Burris to take his seat, at least in part because his letter of appointment from Blagojevich was not co-signed by Illinois Secretary of State Jesse White.

Some of Burris' supporters have bemoaned the fact that Democrats would stand in the way of the Senate gaining its only black member. Burris himself downplayed the issue of race, telling reporters: &quot;I cannot control my supporters. I have never in my life, in all my years of being elected to office, thought anything about race.&quot;

Earlier Tuesday, Burris had tense negotiations with Terrence Gainer, the Senate's sergeant at arms.

&quot;I'm presenting myself as the legally appointed senator from the state of Illinois. It is my hope and prayer that they recognize that the appointment is legal,&quot; he said earlier in a nationally broadcast interview.

Burris dismissed the Senate Democratic leadership's position that he cannot be seated because he was appointed by a governor accused in a criminal complaint of trying to benefit financially from his authority to fill the seat that Obama vacated after winning the presidential election.

Burriss said his belief is that his appointment is constitutional and that &quot;I have no knowledge of where a secretary of state has veto power over a governor carrying out his constitutional duties.&quot;

Burris also maintained that the announcement by Blagojevich Monday of a date for an election for a successor to Rep. Rahm Emanuel, D-Ill., proves the governor still has legal authority to carry out his duties. Emanuel will be Obama's White House chief of staff.

&quot;There's nothing wrong with Roland Burris and there's nothing wrong with the appointment,&quot; Burris said.

Burris has found little support among fellow Democrats.

Senate Majority Leader Harry Reid, D-Nev., had said Monday that Burris would not be permitted to take his seat because Burris &quot;has not been certified by the state of Illinois,&quot; a reference to incomplete paperwork that only touches on the dispute. Senate Democrats maintain that Burris' appointment is tainted because of the charges against Blagojevich.

While Blagojevich has signed formal appointment papers, White has not, and Senate rules require that signature. Burris, in turn, has gone to court hoping to win an order for White to sign the necessary paperwork, and he has also threatened to sue to take his seat in the Senate.

Of all the fights the democrats could wage over the last 8 years, they chose to refuse seating the <span style="font-weight: bold">legally appointed </span> Senator from Illinois.
