<span style="font-size: 20pt">Shopper Faces 15 Years for Cutting Walmart Checkout Line</span>

(November 1, 2009) - A former college student faces up to 15 years in prison for allegedly cutting the line at a Walmart, and the NAACP and ACLU have stepped in to generate support for her case.

Heather Ellis, 24, is charged with two felony counts of assaulting a police officer, one count of disturbing the piece, and one count of resisting arrest in connection with a January 2007 incident at a Kennett, Mo. Walmart.

Pastor Jessie Bonner, president of the Sikeston, Mo. NAACP chapter, told the AFRO that Ellis, at the time a pre-med student, went to Walmart with her cousin. When checking out, he said the two had split between two lines intending to consolidate their purchases with the first person to reach a cashier.

Ellis’ cousin reached a cashier first and Ellis joined her in that line. Bonner said a White woman in line behind Ellis’ cousin said Ellis was cutting the line, and pushed her. The cashier called the store’s manager, who called police.

Bonner said Ellis and her cousin were able to check out, but said Ellis was taunted by police while leaving the store. He said one officer grabbed her shirt from behind and, when she jerked away, they shoved her down, banging her head in the course of making the arrest. Bonner said Ellis was harmed at the police department as well and made to wear a jail uniform that was previously soaked in urine.

Shortly after being processed at the police station, all the charges against her were dropped, Bonner said. But a few days later, the State’s Attorney called her and said the incident would go away if she would sign a document pleading guilty to disorderly conduct. She refused and shortly afterwards he filed the charges she now faces.

However, a police affidavit obtained by the Southeast Missourian newspaper tells a very different story. According to the affidavit, officers arriving on scene allowed Ellis to leave the store, but she became increasingly hostile toward them.

“I tried to convey to Heather Ellis, as best I could, that all she had to do was leave peacefully,” the affidavit states, according to the newspaper. “However, it was incredibly and abundantly obvious that [she] had absolutely no desire and/or intention of complying...” According to the affidavit, police attempted to arrest Ellis, who became combative and struck two officers before she was handcuffed.

A rally and march to support Ellis are planned for Nov. 16 at 11 a.m. The coalition is asking individuals to come to Kennett, Mo. to participate, or to write letters or hold rallies in support of Ellis at their local Walmart at the designated time.

“We are looking for something on line with what was done for the Jena Six,” Bonner said about the march. The group is also hoping to raise money at the event to help cover Ellis’ legal expenses.

(November 1, 2009) – On Nov. 18, Heather R. Ellis goes to trial in Dunklin County, Mo., on two felony and two misdemeanor charges. She faces a possible 15-year sentence for charges stemming from her allegedly cutting in line at a Walmart store in her hometown of Kennett.
Among the amazing things about this case is that it has taken almost three years for Heather to get her day in court. &quot;We have been fighting fiercely for a long time,&quot; said Hester Ellis, Heather’s mom. &quot;My daughter is telling the truth. She’s innocent. She is ready to tell her story [in court].&quot;
According to Heather’s mom, on Jan. 6, 2007, while Heather was home for winter break from Xavier University of Louisiana, she and her 15-year-old cousin went to Walmart. They each picked a separate line at checkout, agreeing to combine the items for purchase with the first person to reach the cashier.
When her cousin reached the cashier, Heather walked over and handed him the items. Other customers began to say Heather had cut the line, prompting a manager to call the police. Heather made her purchases and left the store, but was arrested on the parking lot.
The Rev. Jesse Bonner, president of the Sikeston Branch of the NAACP and pastor of Divine Second Chance Ministries, said the process of the arrest was brutal. Heather sustained cuts on her arms from the tightness of the handcuffs, he said, and multiple bruises from being forced to the ground. Her mother said they slammed her into a metal door at the police station and the police report notes that she requested and was released to obtain medical attention for her injuries.
The probable cause affidavit portion of the police report signed by arresting Officer A.W. Fisher on Jan. 7 tells the story differently. Fisher states Heather was so out of control he heard her yelling before getting into the store. He said she was cursing at the cashier, store manager and customers and when he approached and asked her to calm down, she turned and cursed at him.

When the children of my assistant Shauntay (Justice and Journi) brought the case of Heather Ellis to me, I was in disbelief. I was shocked that in 2009, a young college student, with no criminal record, could face 15 years in prison for cutting line at Walmart. I was even more appalled by the threats from the KKK and allegations by local leaders that the town went as far as blacking out the local news coverage during the minutes that the family held a press conference in support of their daughter. We sent information about the case to CNN and other media outlets, and they covered it (along with BET, Essence, ABC News and others), but I don’t feel this is enough. We’ve decided that we aren’t going to take this sitting down, and we hope you won’t either

In honor of Justice and Journi, the two young visionaries who convinced me to take on this issue, we’ve created the “Journey for Justice,” set to take place in Kennett, Missouri on Monday, November 16 at 11 am. On that day, we are going to meet at the Walmart where the incident took place (1500 1st St., Kennett, MO) and march to the steps of the courthouse(Square 200 Slicer St.). Given that the prosecutor in the case (Stephen Sokoloff) has asked for a change of venue (to Bloomfield, MO – a town with less than 20 black people), some of the details of the rally might change (I have no doubt that they are scheming to make this as difficult as possible). But I can guarantee you this: On November 16, we are heading down there to fight against the madness occurring in this county, no matter what the cost.

I mentioned the story before about Heather Ellis, the young woman who was threatened by the KKK after protesting about her arrest that took place in a Walmart store. The story was quite interesting in that Ellis now faces 15 years in prison for effectively cutting line at a Walmart. The unfortunate events occurred when Ellis was shopping with a cousin in Kennett, Missouri.
Heather and her cousin went to separate lines and when her cousin found the shorter line, Heather joined him. Ellis was then accused of cutting line by the person checking out customers, which led to an altercation. When Ellis was asked to leave the store, she argued with the managers, which led to the police being called. Ellis was eventually charged with disturbing the peace, resisting arrest and two counts of assaulting a police officer.
Ellis, a college student on her way to medical school, argues that the charges were not appropriate, particularly since she doesn’t have a history of this kind of behavior. She now faces up to 15 years in prison if convicted. Ellis has publicly protested the DA’s decision to push the case forward, which has led to her receiving threats from the Ku Klux Klan. The African American community is working to help Heather now, as a website has been set up for an online protest and petition fighting to support Heather’s case.


The question here, from a business standpoint is whether or not Walmart could have done something to avoid this situation. Some people think so.
Dr. Towanna Freeman, a management consultant, argues that Walmart could have avoided the entire problem by paying greater attention to customer service.

&quot;Regardless of a person's ethnicity, gender, or sexual preference, this case started when the cashier failed to convey at least one of the core beliefs and values of Sam Walton: 'Customers are the reason we're in business, so we should treat them that way',&quot; says Dr. Freeman. &quot;With that said, the cashier could have easily interjected and calmed the angry crowd by saying something like, 'Excuse me, although we don't promote cutting lines, please allow me to assist this customer now. This will only take a few minutes. Thank you, for your patience.'&quot;

The case for Heather Ellis is heating up. I've made some calls around the country and it appears that the case might finally get the attention it deserves. Also, the Your Black World Coalition is going to get involved, along with the National Action Network, to ensure that this young lady's case is carefully analyzed. The bottom line, however, is that this incident should never have happened and Walmart has engaged in bad business by allowing its stores to be the center of such a racially-charged controversy.

There is the added reality that Kennett, Missouri is Rush Limbaugh country. Respect for African Americans in the legal system of this town is not what it should be, and the more emails I receive about past indiscretions in this region, the more I am starting to wonder if Heather was going to be treated fairly in the first place. The presence of the KKK doesn't help their case and only serves to remind us that we do not live in a &quot;post racial America.&quot;

My daughter and I decided long ago that we would never patronize Walmart, because of their policies towards their employees:
<ul style="list-style-type: disc">[*]Employees are paid so little that they are eligible for welfare and medicade.(They are told to apply for welfare upon hire, because they will qualify. That is their offering of health insurance)[*]In China, where their toys are assembled, they offer employees dorm housing. Bunks are 8/room with 10 people/room. If they choose to live at home with their families, they still have to pay for the dorm room.[*]No unions are allowed. There are cameras everywhere. If the word &quot;union&quot; is overheard the main office flies in upper level execs and harrass everyone associated with that person, to the point of following them in their personal lives and harrassing personal contacts.[/list]

It wasn't a few months b4 they closed it down.
