I think children born in the US of non citizens should not be granted US citizenship until the age of 18 when they can apply for it themselves, or when their parents obtain citizenship while they are still a minor.

I think a child of an illegal immigrant who entered the country illegally with their parents took the same risk and they should be able to apply for a documented status at age 18 if they can prove they have been a good citizen (finished school, no run-ins with the law, etc); otherwise when caught, then they may be deported.

I think if they were in the country illegally they took a risk and got caught. I can understand if the child is a minor they may not have had a say but as an adult you have to find a way to make it right.

I also think immigration fees should be lowered to make it affordable for those seeking citizenship but that will not probably happen.

At this time such laws are not in effect and some of these types of changes may be on the agenda. Current law says if you are here illegally and are caught then deportation may occur.

Just because you're born there and your parents are there illegally, you're not automatically granted citizenship.

wow. that would be a whole lot of stateless children. imagine, born in country but not automatically being a citizen, but not being a citizen of the country where your parents came from. where would you get deported to? which country would &quot;own&quot; you?

there's something fundamentally unjust about your citizenship being denied you because of the fault of your parent; that you have to take a proactive step of nationality where others born in the country don't have to.

MGEE in the US, Jamaica and other countries, children are granted the citizenship of their parents home country when born outside of the home country so they would not in effect be stateless.

I dont think so because the second option is that they are here illegally and can &amp; will be deported to their home country as the young girl in the article is presently facing. Having an option to earn their citizenship because of the action of their parents is a fair one. Demonstrating they are capable of not being a burden to the country they are seeking citizenship is similar to the process used today when filing citizenship papers in the US.

So if the student in the case was born here, here parents status has nothing to do with anything. Now I do know (from experiece with kids here) that parents come here and have kids and fight to stay because their children are &quot;citizens&quot;. Most times the USA have sent the kids (minors) back with the parents to the parents country of origin.

I've also seen many cases where the kids are here illegally (by way of there parents) and then they are sent back with there parents, once they are caught. Recently, we've stopped fighting about it. It has become so bad (meaning a kid is deported and 6 months they are back again).

yuri, i remember when that distinction of citizenship in the UK was enacted - i think it was done under thatcher.

however, if what ilp posted was an excerpt from US law, there is a difference: <span style="font-weight: bold">in the US, you are considered a citizen of the country if you were born on US soil</span>, and there's no qualifier around your citizenship being attached to the legal residency status/citizenship of your parent (<span style="font-style: italic">except</span> in the instance where you were not born in the US itself).

kia, i had to apply for and receive jamaican citizenship for my children who were born in canada, and both their father and i are jamaican citizens by birth.

i'm still having some trouble getting your justification for deporting a child that is born in the US when the law, as far as i can see, makes no distinction between the legality and illegality of your parent when defining you as a citizen by birth.

it's not a matter of being 'considered' a US citizen - it's Constitutional law. It's a basic tenet of that 'all-important' foundation document, that if you born on US soil you are an american citizen by birth &amp; that cannot be revoked. (unless the entire Constitution is changed)

that's precisely why so many ppl want to get here first, and have their kids born here. even if themselves are not here legally, they dang well makin <span style="font-style: italic">sure</span> their kids are citizens by birth.

No it does not MGEE. I stated what I think the law should be - grant citizenship to children where one parent is a citizen (natural born or naturalized).


In the US, citizenship for children born abroad is similar to Jamaica in that one has to file the paperwork for the citizenship.

ok. thanks for the clarification. (thanks too, sistacaf). i still don't really agree with your position, as i didn't with thatcher's, but i respect ur right to have it.
