Someone I am acquainted with is incarcerated in NY...on a domestic violence thingy...

looked him up and it shows that there is an immigration warrant...wat does that mean? He is married to a citizen and she has filed papers for him

It probably means sey, shi got PO and decided fi also drop ah dime pan him tuh immigration, in addition tuh di local police. Which also means sey dat, him likely wi get sent back tuh Jamaica, unless shi try fi withdraw di charges. Mi sey try, cause, in mose states, if di police shows up an dem si evidence dat dere was vilence, di odda spouse noh haffi press noh charges, it is automatic dat di culprit ah goh ah jail. Yes, sometimes people wi duh stuff fi mek ie look like dem did get attacked, but usually di police wi mek di call after dem talk tuh both parties, an any witnesses involved.

she did not report him to immigration....and i don't think she can withdraw the charges....police has been called to the residence too many times and they have sufficient evidence without her testimony to convict him..pictures of bruises and damages to the home...plus when he was initially placed in a holding cell he had access to a telephone and would constantly call her and harass and threaten to kill her until she reported it...they have it on recording. ...oh ...the thread is in Dear K...I need to go update....

The 'immigration warrant' means that the NY penal system has told INS/ICE/USCIS, that he is in jail and for what.

Not great because this means that INS/ICE/USCIS is aware of the offense.

The &quot;F&quot; just stands for felony. ie, if it were an &quot;M&quot; it would have meant misdemeanor.

Does he have a lawyer - a very good lawyer?

Skells - I just went down to DearK and read your thread. Wish I'd seen that before.

Couple things - but you prob already know ...

Unless Johnny Cochran has risen from the grave, his goose may already be cooked.

The PL 120.05 02 in particular, is not good at all - in fact, I <span style="font-style: italic"><span style="font-weight: bold">think</span></span> it's mandatory time - but I'm not sure, I'm not a lawyer.

Second, please listen to what I'm saying here ...

... you need to GET AWAY from this woman and this situation. You don't want to get caught in the crossfire. And sometimes that crossfire is literal. All kinds of unimaginable situations can crop up that you don't expect. There's nothing you can do for her or him, so get away from it.

Skelly - does the fellow <span style="font-weight: bold">have any priors</span>? That is also key.

If no priors - it's possible to MAYBE work something out.

If he has priors, then it's not a good situation. At all.
